Universal credit question

Sorry I'm posting for traffic as I need quick answers!

I'm separating from my wife but she's currently in the home. I'm trying to apply for UC but don't know how to describe the relationship on the form. I've added her as a person living in the house, but when it says 'do you have a partner' what do I tick?

Yes and we live together
Yes but we do not live together
No I'm single

None of them seem accurate! As I'm not single, we are legally married. But if I say we live together it'll get treated as a joint claim.

Unfortunately for universal credit purposes you still live together and thus it is a joint claim.

You need to move out

Put it as single then immediately you have completed the claim write a note on the journal explaining you are legally married, living in the same house but you are separated and sleep in separate rooms etc.

You can't then be accused of fraud as you have been clear about the situation and they can assess your claim.

Thanks @Allllchange I didn't know you could add notes, that's a big help as I have another grey area to explain to them!

@Dishwashersaurous split couples can claim while living in the same house, as people can't always move out. In this case, I will not be moving out anyway, I'll stay with the kids and she's looking for somewhere. But we've already split finances and living habits so I need my own money.
