Apple Watch issue HELP

I've got the series 5, and won't pair with my iPhone unless i do the update, not a problem, except the update can't take place as a pop up comes up saying am not connected to the internet. I am!
Been on the phone to apple for over an hour, tried everything with no luck! They are due to call me back in couple of days.

Has anyone else had this issue ?
Could you resolve it?

It's a new watch, dh bought and used a handful of times, since then it's just been sitting in its box. It's still in warranty. Apple said if it can't be resolved I'll most likely have to return it back to where I bought it from, but the warranty is with apple and what's the point of the warranty if they are going to tell me to
Go to retailer I bought it from.

Have you done a factory reset of the watch, rather than just delete the tie to your DHs phone?

I now can't get my old series 3 watch to pair either. (When j was trying to pair the series 5, it somehow removed my series 3 watch that was already connected, according to apple that shouldn't have happened)
Initially it connected and said it's downloading update, my phone automatically locked, I unlocked it and saw the update has stopped and when I tried to do the update again, I got the same mssg that I was getting from the series 5.

So I now have two watches that won't pair!! Am thinking is it a security feature because I tried the pairing option more than once too close in time? If that's the case wouldn't apple be aware of their security feature!
