I was rear-ended on Saturday, stationary in queue of traffic and car ran straight into back of me. Other driver "didn't see me".... He asked me not to go via insurance - he'd pay. I've let my insurance know, but not yet claimed or passed on his details. Took my car to garage, estimate at least £1600. Passed estimate on. Other driver has asked me to get 2 more quotes. I've said no, that if he doesn't want to pay I'll just go via insurance. I don't have time to go get more quotes. I'm under no obligation to do so. AIBU? I also expect the money up front before I arrange to get the work done - too risky that I get it done and then he refuses to pay.

Just go through your insurance. You've already notified them. Let them deal with him. There could end up being more damage not initially noticed.

I hate it when they offer to pay, it's just hassle for you when you haven't done anything wrong. So much easier to go through the insurance and no, your absolutely under no obligation to get quotes, like you said, you don't have time.

He's just messaged me to say he's at work and will "sort it" when he gets home. I can just see what will happen. He'll still say he'll pay, he'll need time to get £ together. I need to let my insurance know within 21 days or it affects whether or not I need to pay my excess. He'll either string it out, or agree to pay and I'll be left with a bill when they find more damage. I'll give him until tonight and then raise a claim..

Pass it to your insurer and don't engage with him any further. What a prick

As soon as he said get 2 more quotes I'd have said no, I'm going through insurance.

Insurance claim in. Insurance seem to be pushing me to put in a claim for personal injury.... but of a "twingy" back and shoulder, but surely that wouldn't warrant a claim??

Go for it, you might need private physio. If it gets worse and you have to wait for NHS physio it might impact your quality of life.

(I work alongside senior physios in work - perk of the job is advice over lunch break).

Always go insurance. You need professionals to deal with people pissing you about, its what you pay for.

And a "twingy" back now might be a long term problem - the law in this country won't end up giving you thousands but it will cover you getting it properly checked out

So glad this thread was quickly brought to a sensible and satisfying outcome! Definitely right to go through insurers.

Now put a claim in for whiplash. You probably have it so it's not wrong. These things can plague you in a low-level manner for far longer than you'd think so the physio may be helpful. And the money is only fair compensation!

Please claim for your 'twingy' back. I had a very similar scenario about 5 years ago. I still suffer with pain in my shoulder and numb left arm and thumb now (instinctively reached down to put hand brake on as I saw him coming and jarred my whole arm). I wish I'd mentioned it at the time as I might have been able to pay for some physio.
