Hiding income CMS help!

Hello, I'm new here. I've struggled along on my single parent journey since 2005. But still, all these years later my son's Father goes out of his way not to support his one and only son. He is 16, in fulltime Education, lives with me now full time (used to be alternate weeks, but my son said he didn't want to go to his Dads anymore (long stressful story)) After 6mnths of zero support, and not even pocket money for his son, and his new boat, I reached out to CMS. They, of course, did their bit- but he's not been honest. He earns approx £1675- £2000 per week as a TV editor, said he takes the minimum about £700 a month. He's not declared any dividends (maybe he doesn't pay those to himself) but how do you pay for a 3 bed house, 2 cars, a boat, travel to London weekly for work .... He got away with support payments of £11.64 from 2008 to the end of the CSA. Now he pay £27 per week- that's less than his hourly rate! He'll not speak to me, and the last conversation on email 2years ago he stated I should never ask for money again. But I can't do this alone anymore. I'm broke. Mentally and emotionally on this endless battle for him to just do his bit for his only son.

Is the 700 a month all her declares to HMRC or is he just lying to the CMS?
Living a Champagne life on a delcared income of a beer budget is how the tax man got Al Capone (US obviously).
Surely the UK tax man has his real income, if not maybe they need to know about his lifestyle.

lifecouldbeadream · 12/02/2020 10:28

I’d be googling Lifestyle inconsistent with earnings- HMRC will no doubt be interested.

GinisLife · 12/02/2020 10:31

Go onto companies house and search for his company. Go to filing history and look for the people tab. If he's sole director then the likelihood is he's sole shareholder as well. You can only pay dividends to shareholders. So unless someone else has the shares in their name he's drawing the dividends.

timetravelquestion · 12/02/2020 10:33

Contact HMRC as he is probably lying about his income to them too. You can do it online anonymously!

Disquieted1 · 12/02/2020 10:35

Sounds like he's paying himself minimum wage through his own limited company then taking the rest in dividends. If he just sends his payslip to CMS, then they will calculate it on what they see (just the salary) as they're often lazy/overworked.

Recommend you get on to CMS and press them to take his entire income into account. They should do this. But you will have to keep the pressure on - it is all to easy for them to just accept the payroll salary and tick their boxes rather than dig into company accounts to work out his real income.

Good luck.

Yes contact HMRC

CakeandCustard28 · 12/02/2020 10:37

I’d push them to investigate and work with HMRC to work out what he’s really getting. Good luck though they aren’t the best service, hugely over worked.

maddening · 12/02/2020 10:41

This is where there should be joined up thinking - if he only earns this then the rest must be bought with fraudulent earnings - hmrc should investigate him.

MrOnionsBumperRoller · 12/02/2020 10:54

Good luck OP. DDs Father does this, CMS couldn't give a shit and are completely incompetent and despite my reporting numerous times to HMRC nothing has happened.

airbags · 12/02/2020 14:32

take a look on companies house at his last accounts and see what dividends were paid.

bexd · 12/02/2020 15:20

So wonderful of you all to reply- thank you!! Really thoughtful. I have checked his companies house records, he always files Micro-entity balance sheets. He keeps his fixed and current assets low (somehow?)
He's now told his son, as he's paying support, he's stopping his £10 a week pocket money. It never ends. ;(

I did try the old CMS to do a variation and review his real incomes, but it went nowhere... I was hoping they had more power to investigate more deeply now... (living in hope)
