Hi all
Anyone know where I stand with this pls?
In September I ordered a crib for my sister (gift) for her baby who is due this week.
3 weeks after I ordered it, sister told me she had already purchased same crib from elsewhere for cheaper and to get a refund so I contacted the shop I ordered it from to be told I will only receive 20% back refund as its bespoke (dunno how, sister has same one from elsewhere). I thought I might Aswell keep it and I'll sell it.
Any way, contacted shop 3 more times asking when its coming, been told its coming from Malaysia and will be here mid November... Still not here. Then got an email saying its now not coming until end of Feb but would I like a loan cot!
Absolutely fuming, said why couldn't I have cancelled it months ago like I asked and I want a refund to be told I'm being unreasonable because the shop will be at a loss.
Anyone know where I stand with this?
I don't think I'm being unreasonable at all!! Angry

How did you pay for it? Can you raise a chargeback via credit card company?

Er, a shop that doesn’t deliver on time deserves to be at a loss. Not your problem. Being 3 months late for delivery with a crib is no good, the baby could have outgrown it in 6 months! Seeing the order terms and conditions would help re the “ bespoke “ claim- in what way is it bespoke, did you specify some colour or design?

But generally you should be able to push for refund on grounds that item needed for a specific date and not available when required.

Even if you hadn't already tried to cancel, a crib that arrives months after the baby is useless! They're in them such a short while.

I'd go the 'Just give me my money back now,' route calmly every single day. Contact a consumer rights organisation to find the right legal phrases if someone here doesn't come up with them.

What a shower! Bespoke indeed. My nearly GC is going into a vintage wicker Moses basket on bamboo stand (£10 in the charity shop) a posh bedside crib (half new price on FB marketplace) and a refurbished secondhand cot (from DiL's friend). Why spend more? The dearest bit will be brand new mattresses all round. Essential.

You certainly have good grounds for a full refund!You can also complain and get recompense for the bespoke claims. I dont understand how even if it was you would be entitled to only 20% refund xx

Write to them making time of the essence: say that unless they can deliver within a week the contract is cancelled and they must repay your money. If they won't, reclaim it through the small claims court.

Pay that as much attention as their claim to have sold you a "bespoke" item that your DS has randomly managed to purchase a replica of ...
The shop are chancing it.
Point out that they have mis-sold you a 'bespoke' item that is no such thing, that the have let you down time & again on delivery, have kept you waiting an unreasonable amount of time, & unless they refund you by X date, you will be going Small Claims, & they will lose.

Also start agitating on their social media pages. You just need to be persistent.

YANBU, if they're at a loss it's their problem, not yours- they shouldn'tve been crap or relied on crap suppliers or whatever, and they now know and can change what they're doing in future.

I even mistrust their claim that it's bespoke, if they're importing it and your sis says she has the same one.
