Aibu to just put a claim in?

So I ordered a large item through someone selling on eBay, although when sorting out the final details the payment didn’t go through eBay (silly me) but through PayPal services.

I paid 3rd June, the courier picked it up 5th June. It said it would be delivered 8th June, it didn’t arrive and the tracking online said it was delayed.
I messaged the seller on 10th to ask if they had been in touch with her at all, she said they hadn’t but would call them the next morning.
I messaged on 13th and she said she had try to call but had no luck and that she was on holiday for just over a week now.

I contacted Hermes myself who said they couldn’t find the item. But they couldn’t speak to me about it. So I messaged her again to ask if when she was back if she could contact them to find out what was happening. I gave her the contact name/reference number.

I had no reply so messaged again once I knew she had been back from holiday for a couple of days. She messaged 5 days later to say she had left her phone at the airport and just picked it up.

I asked her to call them and she said she would. Messaged a couple of days later and she said she hadn’t been able to get through to anyone.
I gave her the number on google which I had been able to contact them on.

She said that she spoke to them and they would refund within 14 working days. I messaged today, which would be 14th day and no reply yet.

Aibu to just put a claim in with PayPal? I am £200 out of pocket with no item either.

Raise a dispute with eBay and they will open a case and reverse the charges. They will be able to see your messages so will see you e been trying to resolve it.

Definitely put the claim in with PayPal. I spent £130 with a well known department store and, after trying the items on, sent them back as unsuitable. Over a month later I was still waiting for my refund - the company acknowledged they’d received my returns 2 days after I’d sent them; the tracking from Royal Mail said they’d received them; they even told me 3 times in that month that they had processed my refund and it must be PayPal’s fault if not received it.

In the end I contacted PayPal who said no refund was showing as pending and took some details from me. They said I had to wait 10 days while they investigated the issue and gave the department store time to respond to them after which time PayPal would refund me and they would take on the responsibility to chase the department store. I got emails from the PayPal employee who dealt with my call detailing the issues, the plan and the expected timeline.

I had the money back in my bank account the day after the 10 days was up - and a follow up email from PayPal stated the department store had failed to even respond to them let alone try and defend themselves!!

One of the reasons I will always use PayPal when purchasing online if the option is there!!

I have spoken to the seller and she said she is going to chase them tomorrow but refund me either way. I’ve given her the benefit of the doubt, and If she doesn’t tomorrow then I’ll put the claim in tomorrow evening.

I hate being pushy/confrontational but I’m the one down and don’t see why I should be the one waiting. I could really do with the money at the moment as I need to urgently re order the item I bought from her for my business.

Fingers crossed the refund shows tomorrow so I don’t have to have the hassle of the claim.

Bollocks she did. She’s stolen £200 from you. You don’t know her and don’t owe her anything - I think you’d be mad to give her any more time! Seriously, you should escalate this with PayPal now

It could be a dodgy seller but you did say it was Hermes - they are such a dodgy company, we've had stuff stolen by them before.

Don't engage further with the seller, they have had plenty of time to resolve this.

Put the claim in ASAP. There is a time limit on claims, I can't remember how long it is, but don't miss the boat due to the sellers procrastination.

Hope it gets resolved soon.
