I'm about to go through the court process re access for my abusive ex to our 6 month old. I hope this has an impact. I'm terrified.

I hope emotional abuse is considered too considering how many people I know who have experienced it as children.

Evidence is always the issue, in both directions. People can take innocent things and make them out to be evidence of something that never happened, and equally there can be horrific abuse but no evidence of it. There will always be mistakes, it's just impossible to know what's absolutely true.
