I was invloved in a car crash last year caused by a stupid man that resulted in me having to have 3 months off work, burn scars, hate travelling, wrote off my car and broke some bones in my hand.
Also caused whiplase to dh and dd, and forced us inot another car carrying 2 children, a preggy mum and a nan

He had no driving linense, mot, tax, failed to produce documents, and was charged with driving without due care and attention. He has failed to turn up at court 3 times and finally turned up on 30th May!!!

I have had letter, he was given a fine of £120 and £50 in fees!!!! thats its , oh 6 points on a linense he doesnt have! grrrr I am so mad. I have lots my no claims, £400 excess and all emptional and physical pain.

I cant believe thay call that justice

Thanks for letting me rant

Lisa

could you take this to the cps if you are still having health probs??

elasticbandstand · 22/06/2007 22:31

justice system, (sometimes) stinks doesnt it

Elasticwoman · 22/06/2007 22:32

I suggest you write to your MP about it. Also, was your case highlighted in the media? You could try naming and shaming the culprit.

Lisa, that sucks Have you applied to the criminal injuries compensation lot? I know it's the principal and not the cash, but you're probably entitled and should give it a shot?
Good luck x

lisad123 · 22/06/2007 22:48

The composation claims are going though the Motor insurance buerue (sp??) is that the same thing?

lisad123 · 22/06/2007 23:23

Im really not to worried about the money, just cant believe what he got!! It cost more than that to get a linense!! GRRR

not entirely sure of the details, as things might be different here in Scotland, but give your solicitor a ring Monday and ask him / her to explain it all, that's what they get paid for and you could prob do with a good holiday if you do get any cash.
Let us know what happens? xx

themoon66 · 22/06/2007 23:29

That is terrible... how unfair that YOU should lose no claims. Am seriously angry on behalf. Grrr. And 400 bloody quid excess! and him with NO excess coz no insurance.... rant rant.

sorry too much wine.... but still ... grrrr

lisad123 · 22/06/2007 23:39

I rang police that sent letter and they said, we dont have details, you have to ring court. GRRR.
I blamed myself for ages and felt so bad as they preggy lady was on back board and blue lighted (like me) and those poor children. I miss my little car and currently have one on lease from work, but when I leave I will have no car at all
It just seems so unfair I could cry 9properly preggy hormones too

I would feel tempted to contact the media. It may not help your own circumstances but may attract attention to help change the law in order to get a more apropiate punishemnt for such level of irresponsability, even if that punishment is to clean the rabbits to the side of the roads for a year as a community service.

It is a pity you can't sue the justice system for adding up to your pain. I really don't know what is worse, if being hit by such an idiot or seeing him walk free without a conmensurate punishment.

lisad123 · 22/06/2007 23:41

I would have rather he get community service than such a stupid fine (that he properly wont pay) least he could think about what he did then.
I guess the only good thing to say is, he did help DH rip DD door open as the car was so badly buckled the door wouldnt open.
