Employment Advice Needed

DH experienced racial abuse at work, he was called some racist names by two colleagues. He reported this to management who dismissed him.

He recently sent an email to the managers asking them whether they had investigated and the outcome. His manager said that they spoke to the 2 men involved and they reported that they had a disagreement with DH however they had not been racist towards him. His managers said that they had also spoke to witnesses who report they did not see anything.

Surprised DH spoke to his two colleagues who were there and they have told him that the managers had not called on them to give a statement. They have since wrote a letter which substantiates DH claims and have given this letter to DH.

DH is very distressed by what happened at work. He is also on a performance plan for poor performance; he is working towards targets to improve.

Advice on whether DH should take this further or would this rock the boat to much given his vulnerable situation.

You say management dismissed him, do you mean they dismissed his complaint or sacked him. If he has written proof that he was abused then he could ask for a meeting with the manager if he wants to stay in his job, is he happy to stay there where the staff are racist and the manager is a liar. What sort of work is it, would it be easy to find another job. Also is he in a union or contacted ACAS in the UK for advice.

Sorry they dismissed his complaint. He is currently in the same company (factory work) on a performance work plan.

Has he raised a formal (written) complaint about the racist comments? I think he should, enclosing the statements from the witnesses, possibly it is worth submitting it to his next-in-line manager (ie his bosses boss) as his immediate manager has been un helpful. It is worth setting out what he wants as an outcome, e.g. to be separated in future from the two men if this is practicable.

Ok of course there's a risk of backlash but if no one ever complains about these things then nothing will ever change... But I wouldn't have thought it will change the fact of him being on a performance plan either way as presumably it's two unrelated matters. Maybe time to look for another job as this place doesn't sound good on multiple fronts?
