I'm hoping someone can tell me if there is any course of action i should take here. Many weeks ago i set up a payment plan at the dentist for some dental work. My dentist uses a finance company that, after checking my details agreed to fund my treatment and would take a monthly direct debit from my account.

However, well in advance of my treatment starting i had to cancel, which my dentist said was fine and that they would inform the finance company that the agreement was cancelled. All should have been fine, but come the due date when the first payment would have been due i find that the payment had been taken.

I rang the dentist and the receptionist told me that she was sorry but she had forgotten to inform the finance company. She then did so and told me that the money would be back into my account within 8 working days. Two weeks later, still nothing. The finance people now keep fobbing me off, still no money.

I should say, there's no question of me not being entitled to my refund, the dentist told me they're legally bound, it's just that they're dragging their feet. Help anyone, what should i do. Sorry for the long droning post.

Maybe the money coming out of your account is the dental membership fee and you've misunderstood. How much is it coming out?

They took £160 and no, there is no membership fee. Otherwise they'd have told me, they keep saying "it'll be there in the next few days" but it never is.

Was it taken by direct debit? If so contact your bank for a refund under the direct debit guarantee. They will then claim in back from the company

So you spoke direct to the finance company? What did they say?

Yes it was direct debit, and yes i spoke to the finance company. I had to speak to them right from the beginning before they agreed to finance it. They have said i will get it it but i can't understand the huge delay.

Do the finance company record their phone calls? I'd be speaking to them in a fairly robust manner and insisting that they transfer funds TODAY or I dunno, something - a complaint to the financial ombudsman perhaps?

It's the bank that is obliged to give your money back in cases of direct debits taken incorrectly. Speak to them to get the money back faster

If you paid by direct debit, contact the bank and tell them. They might get a refund for you.

Find an email address to them, email all the facts and say you want to make a complaint.

I had to make a complaint against my finance company today who were basically trying to rip me off - I quoted relevant sections of the consumer credit act and made it clear they were breaking the law and they emailed back swiftly saying they were issuing a refund.

Have everything in writing so there's a paper trail.

Google your situation to find advice from people who has been in a similar position.
