To wonder when I don't have to pay it back?

I am happy to pay it back but I'm getting annoyed and I'm out of pocket and possibly having my tax messed up.

I left my job almost a year ago. I am now employed somewhere else.

I realised 4 moths ago that my ex employer (large, house hold name) have still been paying my Childcare vouchers. I know I should have noticed before now but I emptied the voucher account and everything else was OK so I didn't think to check. All the money is still there, I haven't used any of it.

I contacted ex employer as soon as I realised and they said they'd look at it. I've emailed them every month to get the same response. I don't want to call as we didn't leave on good terms but clearly they aren't doing anything because they are still paying it each month.

I want to join my new employers scheme with a different voucher provider but I know I can't have two schemes running at once. So that is leaving me out of pocket. Luckily my childcare costs are now a quarter of what they were.

I'm also confused (concerned) about the tax implications. Does any one know what impact this will be having or if I'll suddenly be lumbered with a big bill?

At what point can I tell my ex employer that I've made all reasonable efforts to sort this out and I'm now going to assume the vouchers are mine to spend? As I say this is leaving me out of pocket as I can't join my new scheme and it's possibly increasing my tax.
