Test drove and put a deposit on a second hand car last year, whilst they MOT'd and replaced a broken indicator light casing. Went to collect on the final test drive and the engine didn't rev past a certain level - clearly faulty.
Refused to take the car and requested deposit back as the car was faulty and nowhere stated it was a non-refundable deposit. This was refused.
So we went via the bank and got a chargeback - told case closed. HOWEVER, the garage has contested and proved we authorised our payment with a signed receipt - but this was never our claim, it's faulty goods!
At no point were we told they could contest and to retain evidence, we did have a video but it's been deleted at some point in the last few months. We provided the receipts which do not state non-refundable.
Is there anything we can do? I'm so annoyed with the cheek of the garage and the incompetence of the bank - the car is still for sale (surprise!) they've lost nothing from the failed transaction other than a £30 MOT which would've been done at some point regardless
