Rental Increase Question

We have a rental 3 year rental agreement. The managing agent just phoned that we were due for an increase between 3-7% in May but there was an oversight on their end. We had a verbal agreement to a fixed rent for 3 years and did not realise we signed the lease stating they were able to increase the rent. My question is when can they do the increase if it says annually and we are already 6 months into the second year or tenancy? Thanks for you help

flg728 You should send that gov.co.uk quote to the LA or LL who ever you are dealing with and tell them you agree to a 3% increase as of May 2018 after the 6 month notice period.

So you didn’t read the lease? You signed a legal document without reading it.

So if you had read it before signing, you would have had the 3-7% rent increase taken out...

Presumably they deny the verbal agreement?

If I were you I'd be reasonable but firm - offer to accept 3% in January, perhaps, or whenever 18 months of the 3 years falls? I'd actually probably negotiate 3.5% (expecting to agree on 4% or 5%) with the clause that there won't be another rent rise in the remaining term - otherwise you'll agree to 3% now, and another 3% minimum in 6 months...

It wouldn't hurt to mention your verbal agreement, I did! There was a change in management of my property and they quite rightly implemented their standard rent increases.

I stated I wasn't disputing the annual increase but asked for clemency... they responded fairly with a date of increase 3 months later, to be reviewed on that date each year.

Worth a pleasant letter.
