Hi I posted before about this on here. I live in a ground floor maisonette, it's basically a house but has a one bed flat above. I have a garden. When I first moved in my friend noticed the communal door to the upstairs flat that is in my garden and said my garden must be shared. I contacted the council who said it wasn't and said the garden was sole use. 3 years have gone by and I've had a private garden. However about a month ago some people from the council knocked on my door and said the cupboards in the back garden needed to be cleared as upstairs (which is 2 flats) are going to start storing there wheelie bins in there, these 3 wheelies bins have always been kept in the front since the years I've lived here. Now I'm obviously annoyed as that would mean my garden would no longer be private as several other people will now have access to it! The flat directly above me has 5 people living there and I'm unsure how many live in the other. Now where the communal door is and cupboard a past that is next doors garden. However they have put up there own door so there garden is nice and private so these people will only have access on my side (how is that fair!) so I wanted to put up my own door (see diagram) but whose cupboard is cupboard b?! Surely if it's directly outside my kitchen door it is mine? I've done abit of looking around and have looked online at houses on my street (identical to mine) that have been sold and they have been sold as having cupboard b. So wibu to put up my own door?

I would assume it's yours and yes put a fence up asap!!!!

Look at your tenancy to see what you're entitled to use under the agreement. That will determine what you have exclusive use of.

There's nothing in my tenancy and can't get any clarification of the council, I've called 3 times.

Usually ground floor flats have exclusive use of the garden, unless it specifically says otherwise in the deeds or tenancy agreement. A fence sounds like a good idea but you really need to do it straight away. If you want until they've already had access you're going to have a huge battle on your hands getting them out of your garden again!

if they just want to use the cupboard then can't see why you shouldn't put a door up (but best do it quick!)
Why can't the bins just stay out the front?

Apparently they are a "fire hazzard" at the front, despite being there for 3 years.
