My child broke an arm at nursery and clearly I don't want him to go back - it was negligence on his key workers part completely!
They want 4 weeks paid notice! Surely as it was their fault i don't have to? Where do I stand?

16 months is not 2 or even close! If he was 2 then yes he's still a baby! I see why you're upset op but I'm afraid I do think accidents happen. I love mine dearly and look after them really well (I think!) but they've both fell off beds, settees bumped head ect. Kids that age are like lightening and into everything. If you feel uncomfortable don't send him back and if you don't pay I doubt they'll take you to court.

I'm sorry this happened to you and your DC.
It's awful seeing them in pain and you sound very understandably traumatised by the whole episode Sad
Has the manager contacted you?
They need to do a full investigation, is it a private nursery?
I would seek some legal advice, or consider getting this moved to legal matters.
You are too fragile for AIBU in this instance - as I would be.

I would be absolutely amazed if they went to the small claims court over 4 weeks' money after this. Poor little thing. Hope he feels better soon. I wouldn't agree a deal with them to waive the £ in case you need to sue them for negligence.

Poor wee boy! I think many PPs are being very unfair on you. I would expect my baby to be adequately supervised and for this not to happen. I'd be furious too! An accident would be your baby tripping and falling, not having time to climb up onto a chair and then fall. It is supposed to be 1 carer to 3 babies in the baby room and I would expect that to be enough to stop incidents such as this from happening.

I wouldn't pay and I'd let them take me to court if they wanted it.

And of course a 16 month old is a baby. It is much closer to one, four months from one and 8 months from two. Does that mean the day after your first birthday you are nearer two? Ridiculous.

I hope your baby is ok and recovers quickly.
