About the parking space or is FIL?

This isn't intended to be a PILs bashing thread, I like my PILs, and I genuinely don't know who is BU here.

DH and I live in a terraced house on a residential street. Parking is always available on our street, but often not right outside out house.

There are two disabled parking bays marked out near our house. We aren't near shops or any other amenities, so I assume that they are there because in each case the property of the house they are outside has a blue badge and has applied to the council for a space to be created.

MIL has a blue badge because of hip problems. She can walk, but slowly and it's uncomfortable for her. She uses a stick.

When PILs visit us FIL will always park in one of the disabled bays if it is unoccupied and nearer to our house than any other space. He may be occupying that space for hours at a time.

DH and I think (and have said to him) that he shouldn't do this because the person who had the space marked out presumably needs it. FIL's view is that MIL meets the criteria for use of the space so why shouldn't he park there? If each space was intended to be only for use by one house then the scheme would have been set up that way.

She is entitled to park there as she has a blue badge.

A BB space can be used by anyone with a BB so he's not BU, but I can see where you are coming from. My FIL has a BB now, but I wouldn't want MIL to park in next door's BB space as they had to jump through several hoops to get it and imo is on our street because ndn needs to be able to park outside his house.

I agree with FIL (although I can see it would be inconvenient for the local blue badge holders - but no more so than for your visiting BB holding MIL).

I too live in a terraced street. There are a number of disabled parking spaces but these are allocated to certain residents with a sign that it is for 'Badge Holder 12345' IYSWIM.

If there is no sign I would expect it to be for any BB holder but I'm not sure.

She is perfectly entitled to use it. A friend of ours used our NDN's one on occasion, and given that the difference was elderly chap who could walk but with difficulty (NDN) versus wheelchair user paralysed from the waist down (friend), I think friend won out. Was never an issue though.

Yes, he only uses it if MIL is there.

FIL is correct. But could he use the space just to drop MIL off and then move car to further down the road if you are concerned about your neighbours?

Are these bays right outside particular houses? There are a few houses on our estate where there is a disabled bay marked on the road outside the house and no other parking spaces marked - just unrestriced free for all.

I always thought that those spaces were for the use of the resident of the property they are outside so other people, even with blue badges shouldn't really use them - they are for the sole use of the resident only, although I have never seen any restriction.

Do you know the people who live in the houses with the bays? Do they have anything in writing that says that the bay is for their sole use? Where would they park and could they manage if your ILs used their space?

On the assumption that it is not a numbered bay then he is entitled to use it.

I stand corrected. I have googled and see that they aren't sole use, if there is no badge number marking.

Are you thinking he may be taking a bay from a resident, even if it isn't numbered? In which case, could he drop your mother in law off outside your front door, park farther away, and fetch the car to pick her up again from your front door? Then you wouldn't feel guilty. Or does he have difficulty walking distances?

Are the BB spaces actually needed by residents though? Only because sometimes they don't get removed where there is no need for them any more. I lived on a street with two of them for two and a half years, both of which were there for residents who had died before we moved in! Eventually one started being used again by another resident who moved in and happened to have a BB but I'd have no issue with a relative using them if the spaces weren't needed by residents, IYSWIM?

Interesting you should feel someone in a wheelchair should "win" against the walking wounded, RiverTam. It is usually easier to move a little further in a wheelchair than walking with considerable pain particularly if it is electric. Of course the bigger space helps a wheelchair user so I guess it probably needs case by case consideration.

Do you know which house has the BB and if so could you pop round and have a chat? Just say you understand that because it's not a numbered spot anyone can use it, but you'd like to be neighbourly and not inconvenience them. They might really appreciate your concern and open a reasonable discussion.

If you have a car could you move it elsewhere so he can park in front of your house so it solves the issue?

My friend had a disabled bay marked outside their house but they were told by Council (?) that any blue badge holder could park there. They don't like it if anyone parks there but can't do anything about it. So I think you and FIL are both NBU. fence sitter

But yes, as long as your FIL is displaying the BB correctly he's right.

People can apply for those spaces and aren't charged for them (in my area anyway), so they don't 'belong' to anyone per sé. As far as I'm aware all the application paperwork has a caveat to this effect and states that anyone with a blue badge can use them.

So no, your PIL aren't BU, but neither are you really, as you are being considerate to your neighbours. However, neighbours would BU if they complained over your PIL parking there.
