Sorry, this is probably the completely wrong category but I cant find a better one! Dp is a light vehicle mechanic. Yesterday whilst working away (for his boss not another company) he broke 3 fingers and sprained his wrist, all on the same hand. He is now physically unable to drive or hold anything with that hand, so would be useless working ATM. Does anyone know if he is entitled to time of and if so, will it be paid? We REALLY cant afford to lose his wage right now, as I've got nothing coming in. If he loses his wage what can we do...?

He will be entitled to SSP at minimum; company sick pay will be dependent on contract.

I'm not sure if sick pay is factored into his contract at all O.o don't ask, all I'll say is his place of work leaves ALOT to be desired. Anyhow, is ssp paid by benefits or work and how does he get it?

SSP is paid after 4 days of sick leave - certified by a GP with a sick note. The company HAS to pay this, but it's really only a very small amount. They have to continue paying SSP for a certain period but your GP will need to continue to certify sickness.

They aren't obliged to pay anything else I'm afraid. It doesn't sound as if they offer any paid sick leave (neither does my workplace). If your DP has any holiday left, he should be able to take paid annual leave while he can't work which will maintain his wages.

Off to a solicitor's, pronto. Has he filled in the accident book? Or rather has his boss?

I don't know if his boss filled in the accident book. Probably not.. Dp doesn't want to claim anything or report anything just wants his boss to pay him his wage or close to it as were really struggling.

For starters, it's an offence not to report a workplace injury. Unless his boss is a saint, he'll get SSP (about £60 pw) and nothing more. Your DP should understand that anything his boss does that might admit liability for the accident will invalidate Boss's employer's liability insurance.

I feel quite strongly about this because I know someone who was browbeaten into not pursuing a personal injury claim because it would collapse the business, which was a flat out lie.

He can man up, or his family can starve.

Any accident in the work place MUST be logged. I had something fall on me and give me a bloody nose and this was logged. Luckily I was still able to work but your OH must do something now. Has he spoke with his hr department?

How does he report it? I'm stupid when it comes to stuff like this. Can he go to a solicitor without money? We have a £600 maxed overdraft and a maxed out £2000 credit card. No way we can afford it if it costs.

I'm very surprised nothing was reported by management when it happened. There should be an accident book where he works for health and safety reasons. Sorry I'm not sure about the whole legality side of this in terms of a solicitor. He defo needs to read through his contract to find out what sick pay he's entitled to and get a sick note from the gp. Maybe give citizens advice a ring

He goes to the office and says I've had an accident and I need to put it in the Accident Book"

If he is obstructed, he just keeps saying "I've had an accident and I need to put it in the Accident Book"

If you think there will be trouble, he can turn his phone to Record the conversation.

He can take with him a letter saying "I asked to put my accident in the Accident Book, but I was refused. The details of my accident are:
Date
Place
Time
Injury
Action taken (went to hospital etc)

Hand over the letter if he is refused. And keep a copy of the letter, annotated with the date, time and name of person who refused.
