Am I allowed/able to cancel a credit card payment...

...if I changed my mind about the order? I ordered something in the eve on 31st, and since realised I already have it - I have emailed and phoned (left message as no-one answering) the company to ask for my order to be cancelled, but as they have not got back to me, I'm guessing they will now say it's too late to stop the order - can I cancel it on my card to stop it going through, or is that not do-able once I've placed an order?

Something about distance selling?

You probably cant stop it but you can return the item under the distance selling regs even if you've only changed your mind

You can't cancel the cc payment, but under the distance selling regulations, you can return it within 7 days and they have to refund your money. If you return if and they don't refund it, you can ask your cc company to charge it back. You may have to provide proof it's been returned.

I'm not sure who's responsible for paying the postage for it's return (I think it's you, but I'm not positive).

I thought about just returning it, but as the company offer free postage as one of their incentives, the blurb says that if you return something they keep £4.95 of the cost of the item as postage costs (as well as you having to pay to return it) - which seems wrong! Still can't get hold of them, so don't think there's anything I can do :(

They have to refund the full amount including delivery cost - I doubt their contact clause about the 4.95 would stand up.

They can require you to pay the cost of returning if it's mentioned in the required information.

If the package requires a signature on delivery, just refuse to sign and ask the delivery person to return to sender. The sender should then refund you when they get it back.

It's not wrong of them to keep the money if you have changed your mind. Why should the company pay for you to change you mind?

Under distance selling regulations you have 7 days to cancel the order and if its already been sent to you by the time you cancel they have to refund all postage charges. This is in addition to whatever their normal returns policy is. Which website did you order from? (I have a lot of Internet shopping/returning experience!)

Distance selling Regs do not apply to personalised items,made to measure furniture etc, photo gifts.

You are entitled to a full refund, including the delivery cost to you. You are liable for the return costs. Bear in mind though, that you actually own the item until refunded, even if you don't want it, so return by a secure method.

If the company argue about their postage costs, report them to Trading Standards, it's one of the big things they are cracking down on.

Thanks all - very helpful. Despite not replying to my email or call, they have managed to send me an email confirming the item has been despatched, so I will wait until it arrives and then return it - not sure how to get hold of them to confirm that the 4.95 won't be deducted though, if they're this hard to talk to!

Send them an email.

If you deduct £4.95 from my refund, I will report you to Trading Standards, I am entitled to a FULL refund including your postage charges.

No need to say anything else.
