Inconsiderate neighbour

I have a neighbour who comes outside for a dag at least once an hour thought the night every night and stands underneath our bedroom window.
When its cold enough to have all windows shut it is fine as I don't hear or smell it, but during the summer and recently because its mild the window is open and I get woken by it regulary.

It has got me to te point of tears and many times have me or my DH asked him polish to not come out after 11am and before 7am.
To which he responds very apologetically and says he won't, but he carries on anyway.

Then speaking with a friend who is also friends with this neighbour, he tells us that neighbour is annoyed at us for asking him to stop when the land he stands on to do it is shared and therefore we are ring unreasonable in asking.

I want this to now stop for good. At one point it got so bad we had te house valued and were about to put it on the market.

Do I confront him again face to face or write him a letter?

I'd go with water out the window. Perhaps not a bucket full, but enough to make him move on.

Make the dining room/ living room your bedroom and have an upstairs living room.

I hate smoking, hate the smell.

But even I must say YABU. Its like the parking outside your neighbours house or repeatedly cooking strong smelling food, mildy irritating but the price of living with neighbours not in the middle of nowhere.

I hate smokers so I say YANBU. Regardless of common land he is being discourteous. Why don't you shout out of the window every time he lights up? Can you do anything to make his smoking area unpleasant so that he goes elsewhere? If he's young you could try one of those mosquito noise devices (google it).

Approach your local council's environmental health dept. they have powers under the Environmental Protection Act that deal with Statutory Nusiance. It may be difficult to prove a stat. Nuisance, BUT they will have to write to him detailing the complaint. Give the Environmental Health Officer as much detail as possible.

is there nowhere else he can stand? How about outside his own flats? Is he so disabled that he cannot walk five minutes down the road?

All smokers seem to believe that there is an invisible curtain that keeps the stink away, even if they stand an inch from an open window.

tell him you have an addiction to throwing buckets of water out of a window, a known mental health problem.

He might be ALLOWED but personally, if I was doing something that was really upsetting my neighbour I would stop, and stand somewhere else, it's called consideration.

There's not a lot you can do, short of sleeping with the window shut, or moving. What he's doing might be impolite, but it certainly isn't illegal, even in the broadest terms.

If he has complained to another neighbour about your attitude over this matter, then he's not going to stop, no matter how much he agrees when you cry at him, he is paying lip service to make you go away!

RooneyMara..... did you not have a look around the neighbourhood or talk to the previous owners of your house? Then you might have been spared the terrible inconvenience of having to live in a house next to ILL people.

Put some dog/fox/cat shit down there after dark so when he comes out he stands in it. Repeat as necessary. He won't know it's you if your careful, he will go mad trying to find the animal responsible and move elsewhere for his fag.

I love the dog shit idea: And like Pessary...I believe every problem has a petty minded solution that also provides that sweet element of vengance: So, what about this....maybe have it wall mounted out of reach (on your own property) and plugged into a timer switch so it only goes off at night. Blame foxes for the reason you have installed it...heck, maybe its the foxes who keep shitting out there too???

why should he have to go somewhere else when you could just shut your window and get a fan/air conditioner??

It would annoy me too, but you will just have to suck it up and live with it. your NDN is probably just doing what i would do, smile and nod and then completely ignore.

How come this guy is up all night smoking? Is he an insomniac or just prefers to sleep during the day? Surely some potential for payback bin rattling, accidental car alarm stuff when you suspect he is asleep

On a more practical note I suggest some kind of White noise device or relaxing cd playing all night plus ear plugs. Then either move or a get an air conditioning unit before summer.
