Have posted in legal but am also posting here for opinions. Apologies for the long story but here goes. DS's after school club was based at another nearby school - being collected and taken there by staff at the club. They informed us that this would be stopping as not financially viable but DS's school managed to get them to agree to open an afterschool club at their school. The opening of this has been delayed. Just informed of this last week. In Scotland so school started back today.
Back in April/May I had to fill in a form for places at this new club. I specified 4 days for ds and also for dd who is just starting school. DS was on a 5 day contract at previous club even though he only attended 4 days. When he started they didn't offer anything else. Was informed only last week that 4 day placements are not permitted, only 2,3 or 5 days. Aibu to think that they should have told me this sooner? So rearranged work as did DH and we have asked for 2 days now.
Club are insisting I am contractually obliged to pay for 5 days for DS for this week and next as I didn't give them 2 weeks notice of the change. I filled in a form saying I wanted 4 days - couldn't have made it any clearer. There wasn't 2 weeks between them telling me I couldn't have the days I wanted and the start of term.
They are also saying the charges are because I have not given any cancellation notice of the previous club when in fact they had written to me saying the service was stopping at the end of last term. Is that not a cancellation notice on their part? We were 1 week before the start of this new term before they advised of the unexpected delay in opening the new club and as an interim measure could continue to transport children to the previous until the new one is open. Until then I didn't know if I had any childcare in place for the new term.
AIbu to not feel I should have to pay for this notice period? have spoken to staff at the club and they are insisting this notice period is due. I can put a letter in for their board meeting which is next week which I intend to do but not sure it will do any good.
