To not give a refund on eBay?

I recently sold some Diesel jeans on eBay. I bought then for my husband they are a 32w and 34l and my husband is the other way around. We moved house and forgot about them, I discovered them last week and put them on eBay. They sold for £69. The guy who received them just messages me and says he can't do them up and wants a full refund. Now I took a photo of the inner label and measured them by hand....surely it isn't my fault they don't fit him? I put "No returns" on the item as I do with all unworn items. I gave 320 positive feedbacks and rarely sell "new" items (usually selling ex baby stuff) but I don't think I should refund him as I didn't Mia sell them.

If I bought clothes on eBay that were too small I'd go on a diet. Cheeky sod.

If the item was sold as new then you are also subject to distance selling regs..which require you to accept a return for an unsuitable item.
Seller will have to pay return postage and you can refund minus original postage costs.

If you don't offer the returns option and he takes this to dispute then you won't win!! Ebay always sides with the buyer. They will tell him to return the item to you and then you will HAVE to refund including original postage costs..therefore you will lose out!

UPDATE: he messaged me thus morning after I messaged him and told him to report me but not to argue that item was not as described because this clearly wasn't the issue. He replied and said "they fit my girlfriend so I'll keep them." How random?
