Hi New don't know if this is the right place to post
Sorry v complicated me and my husband have 4 children. Baby number 3 is not biologically his :( we split up for @18months and I got caught pregnant by someone else. Anyway my hubby has brought the child up since she was 8 weeks old (she is now 2). She thinks he is daddy and is a v happy little un. Ex (her bio dad) has had no contact since she was 3 weeks old he's in and out of prison and is a complete D$%K!! When she was 13 months he suddenly decided he wanted contact and it is still going through court next hearing in 2 weeks. I am opposing contact as I don't think he's suitable to be around my child. I have recently apllied for a Residency order which I was granted as he has made threats to take her and also applied to change her name to mine and hubbys and other kids which was also granted :). Hubbly obviously has PR for the other kids but not baby number 3. We have been told by the court he can apply for it but if ex refuses what happens.

It's a tough one really

I imagine the court will be looking at what he's been to prison for, whether or not he's a threat to his child and whether or not you can prove he's threatened you.

If your ex refuses...I imagine all of the above will be looked at properly and contact given freely or restricted on the basis of their findings.

IME the courts don't tend to grant PR to other people simply because the mother no longer sees the father as someone she wants in their baby's life.

Thanks for replying. I'll fill u in a little more. We've already had the finding of fact hearing and he admitted everyting more or less the things he didn't admit to he was found guilty of doing as they are on his Criminal record. cafacass doing a section 7 report. I can prove he's threatened me as I have several txt messages which I passed to the police and he was given a restraining order for 3 years. He has been to prison twice in the last year and half for criminal damage towards my property and breaching a harassment order he has also been to prison in the past for harressing his ex, GBH and theft.
