To ask for compensation when nursery sends DS ill and he isn't??

Ds was sent home from nursery mid way through last week with suspected chickenpox (another boy in his room had a confirmed case earlier in the week). I was told DS had spots on his chin, arm and bottom but when I got him home and had a look I could just see a couple on his chin. I kept him home the next day just to be safe but nothing ever materialised so he clearly hasn't got chickenpox (or at last not yet). This has cost me the bets part of two days of nursery plus the 2 days leave I had to take. I understand that nursery need to keep ill children away but they were clearly a bit overzealous this time. AUBI to ask for some kind of compensation (eg: 2 free days)? Thanks

So yes, YABU. Are you expecting them to have trained medical staff on site to give you a formal diagnosis? If not, what duty of care have they failed, exactly?

In my work you are able to take a day sick if your dependant is sick....can you do that? And yes I think YANBU to ask for compensation.

Sorry I meant YABU. If everybody asks for compensation when they get it wrong then they will keep sick kids there and will be a horrible place to send your children.

They have to be safe, especially since there has already been a case (if there hadn't they probably wouldn't have been so quick to send him home). You would have been far more angry if you had found out that the nursery had kept a child there who had been seen with some visible spots and your son had consequently caught it through them not being careful enough.

I'd just be grateful it wasn't chicken pox and that you aren't having to take 2 weeks off. I think YABU since they weren't negligent or failing in their duty of care.

Would you be happy for the nursery fees to go up to cover the extra costs for compensation in these cases? Or for the nursery to fold if they can't cover their costs?

Even doctors make mistakes in diagnosis from time to time. There is usually no talk of compensation unless there has been significant longterm or life-threatening damage. The reason being that nobody wants to pay for a health service that expensive.

Supposing you missed he was unwell and sent him in one day with something catching, would you be willing to pay compensation to all the mums and carers who caught something off him?

Yabu this has happened to us a couple of times it's just one of those things, I would have felt worse if they kept my actually I'll child in nursery just because they didn't want to inconvenience me. It's annoying but at least they are paying attention to your dc!

My kids aren't in nursery just yet so I don't know how this works... do you still have to pay nursery fees for the days they were off sick? I think it would be reasonable to ask for those fees back, but not for further compensation since they were acting reasonably in the interests of the other children.

If you think about it, kaid, they can't get the money by taking on another child when your child is off sick and they have to pay their staff from the fees they get in; they can't just dock their wages because little Johnnie didn't turn up.

You want compensation? What for FFS? A careful nursery? You'd not be happy if another child was allowed to stay with suspected pox would you?

Kaid100 yes of course you still pay for the days when they are sick or you are on holiday as they still have all the running costs (staff, electricity etc.)

Honestly, how do people expect a business to run? 'I'd like compensation because you have been caring and looking out for your child'. Ridiculous.

You can have chicken pox with just two spots

The nursery can't exactly give your space away to another child for those 2 days, can they? You are paying for the slot, not the time your child goes.

Some kids only get 1 or 2 spots when they have chickenpox so yabu.

How did they know them couple iof spots were not chicken pox? Could have been the start or your child may be the lucky one who only gets a couple.

And of course you should not get compensation. The workers still have to be paid plus other bills. You pay for the slot at nursery as they cannot just advertise to have another child for the 2 days that yours was off for

OK, I'll forgive you since you are new at all this but I'd also recommend that you ask the nursery for their policies so that you can understand how things work a bit more. Parenting is a learning curve of all sorts of things, but you'll encounter much worse than this and no one will be talking compensation, trust me.

Could you not apply for dependents sickness leave with your company? You should be entitled to a certain amount rather than having to take annual leave. I'd also recommend that you read your company policies plus government guidelines on your rights at work as a parent so that you can be more informed.

You may find that he had a very mild case and hasn't made him immune - my DNephew had it, had only a couple of spots, but caught it again from my DS (who was spotty but otherwise perfectly well!) and had it ba-ad...
