I strongly suspect that this is the only way they can get the insurance company to pay out. It's not a criminal case, and the age is probably irrelevant. It can be the same here in the UK - if someone falls down your perfectly maintained steps and suffers damage then they may well have to take legal proceedings to get your insurer to pay up. Don't see why the fuss about the lawsuit, I'm more irritated by the over-hyping by the press.

It's still an awful lot to put on a child though. She shouldn't have been racing on the pavement and of course the cosequences were awful but to have to go through court with people saying about how she has caused a death through negligence and must compensate is very hard I think.

Personally I don't think that a 4yo should be held responsible for this death.

Yes she is being sued for negligence resulting in death. That is what the court case is about.

Actually everyone is saying she caused the death - because she did. The question is whether she should be held legally liable, and whether it's right for it to be held over her.

Although the case was not originally about the death, because it was started while the victim was still alive.

The children are being sued as follows:

"The aforesaid injuries to plaintiff were caused by the
negligence, carelessness, recklessness and gross negligence of
the Defendants in the operation and cont-rol of their bicycles" from the court papers.
