I bought DS2 a pair of shoes 6 weeks ago from Clarks and they are falling apart. The upper part is coming away from the sole.

Am I entitled to take them back and ask for a replacement?

if you have the receipt I would take them back as they sound like they are not fit for purpose.

Yes. They are usually v good at replacing shoddy shoes.

6 weeks - def yes go back, try first without receipt.

Definitely entitled to a replacement or refund - shoes ought to last longer than 6 weeks without falling apart. Any proof of purchase is fine, so bank statement will do the trick.

Useful phrases are "not fit for purpose" and "not of merchantable quality".

I never buy clarks shoes normally but i did this time and this happens!!

I think DS1 is very hard on shoes - he has to have boots because of weird feet, and even Kickers only last 6 weeks max. I have never thought this was a problem with the shoes, really, just rolled my eyes and winced slightly at paying for the next pair.

DD is the only one of mine who grows out of shoes, the boys kill them dead.

The thing is he is in his buggy ost of the time that we go out so the soles are hardly worn and he has not worn them enough to warrent them coming apart naturally iyswim?

Clarks are very good, they let me return a pair of brown shoes that I had bought in the sale. I already had the pair in black size 5, but the brown size 5 pinched and were too small. I didn't have the receipt but they still offered refund / exchange and didn't treat me like i was insane Smile - shoes can have faults like everything else.
