Hubbys son adopted by ex's hubby?

Hello, I'm new to this site. I was wondering if anyone knows how I can find out if my husbands son has been adopted by his ex's new husband?

hello,
if your hubbys ex had applied to have her new hubby adopt the child--your hubby would have to give his permission(if he has perental responsability), so he would have been notified

Thanks for responding, my hubby doesnt have parental responsibility, we know she has changed the childs surname but also been told that her new hubby has adopted him, we can't ask her directly as we have no contact with her other than paying maintenance

yep, the same as mumo75 said, a familt member had to get her ex'x permisson for her now hd to adopt her son.
was your husbands name on the birth cert? can it be done if his name isn't on it?

Your husband shouldn't be paying maintenance if his son has been adopted as legally he is no longer his son. So you should find out if he has.

This is exactly our problem, we have paid maintenance for 16 years and just been told (via the grapevine) that the child was adopted years ago?!?! I am really struggling to find out whether this is true or not, any help greatfully received

if his name is on the birth certificate and he has paid maintenance then nothing could be done without his permission not even name change unless his ex has lied to the courts. You could try ringing the courts in the area they live and see if they can help you find out.

Stop paying (pay into an account though) and she'll soon want to know why, gives you the perfect opportunity to ask. If she hasn't had her new husband adopt him then you have the money put aside, if she has then you have some nice money put aside.

Is he involved in his son's life?

My husbands name isn't on birth cert, we only found out about the name change when she requested more maintenance and saw it on the paperwork. I will ring the courts tomorrow and see if they can shed any light on it for me, thank you

Hubby not involved in child life - very complicated! Ex not pleasant etc etc

the courts will not be abel to tell you anything as adoptions are confidential. the cases are not even called by name, just by number

if you search for the child's original birth certificate in the official records it will be marked adopted if he has been

i agree with the others, he shoudl have been contacted as part of the adoption process. if his ex lied and said she didnt know who/where he was ( and she was receiving maintenance) and the child HAS been adopted then she could be in big trouble with the court

Thanks for all your advice everyone, I rang the maintenance office at the court today and told them, they are now looking into it

If nothing else he should have been contacted about the name change (we've looked into it because we were worried my OH's sons names would be changed) but that would depend if it was done by deed poll or not.

Court have advised me today his son hasn't been adopted, the Ex just assumed her husbands name for him, didn't use deed poll.

they can do this but all legal stuff ie bank account, passports etc need to be in original name on birth certificate.
