Can we adopt?

I (28, born/adopted/lived in England all my life) and my husband (28/American) are thinking about adopting in the next few years. We both live in England and plan to live here permanently.

Both professionals with stable jobs, I WFH most the time (even before COVID), and we have just bought a lovely house with a nice garden in a safe area.

Our biggest issue is the following: I have heard that both individuals need to have British citizenship or ILR to be able to adopt. However, other sources say it does not matter, just has to have lived here for 12 months. My husband is American and is on a spouse visa, thus he does not have ILR yet.

Does anyone have any idea which one is true? In both cases, I have heard it from people who work in adoption, so obviously I am very confused.

Thanks in advance
