Hello every one, I was wondering if any of you could help me.

My partner is adopting my son, we have had all the visits and our social worker has started visiting all our referees, she has advised us that we are ready to fill in the A58 form and to take it, along with all the relevant paperwork, to our family court to start the legal part.

My question is, as a step parent adoption, do we apply as a couple or does my partner fill it in as a lone adoption. It isn't clear on the advisory notes and I don't want to fill it in as a lone application if that means I lose my parental rights and get left off of my sons new birth certificate.

I think you both need to adopt him. This is what put me off step parent adoption. But the adoption certificate over rides the birth certificate so you both need to be on there

Thank you unicornpoopoop, I found a charity called Child Law advice and emailed them, they assure me that DF has to fill it out as a sole applicant, you no longer have to adopt your own child. Apparently the step child adoption process changed a couple of years ago.

He just gives them my details and I will become a respondent to the application along with DS's bio dad. Hope fully she is right as I have no desire to be left off my own son's birth certificate :D
