Hello I'm a police officer and I used to work in DA so am familiar with Claire's Law.
There are two routes - Right to Ask (for yourself) and Right to Know (where we tell someone without them having asked).
When a request comes in, an officer reviews it to see whether there is any eligibility for you to know the answer.
If you're a friend of a friend of a new partner for example you would not be told anything.
If you're a partner to a new man, and you have children for example, you would be eligible.
We then normally have a face to face meeting with the requester to guage any problems and risk.
Once it is decided there is eligibility to disclose anything, the person's police record is scoured for any previous domestic allegations or sexual or physical violence. These can include reports not just convictions, and also intelligence submissions (no criminal report, complaint etc)
Once they have been collated, it is sent to an Inspector to approve the wording as it is important it is neutral, factual language.
Then an officer will arrange a follow up meeting with the requester. It's not an NDA but you do sign a form to say you mustn't disclose what we tell you to anyone.
We then read out the disclosure.
You then sign to say you heard it all and won't disclose or put it on social media.
We normally need to see ID at some point too, I think in this meeting.
We then fill in an intel submission to confirm that the disclosure was delivered and this normally includes a risk assessment.
We would never disclose to the subject that someone has asked about them.
If you're asking on behalf of another person eg your sister has a new boyfriend that gives you the willies, then we would go through the same procedure but not tell you anything and instead inform your sister that we are giving a Right to Know where we think it is important that she knows about previous history.
We wouldn't tell the person that someone had requested it, and we wouldn't tell the requester that there was any disclosure. We still wouldn't tell the subject there had been a request or a disclosure.
Hope that helps - ask if you have any more questions.
