speeding point issue - very worried

Hi

recently we received a speeding fine through the post. DH and I share the car. I use it mostly in the week but the speeding incident was on a Saturday afternoon. DH and I struggled to identify who it was on that particular day but eventually decided that it most likely me as I use that road a little more often than he does.

We named me as the driver, paid the £100 and I took the 3 points. We have both done a speed awareness course within the last 3 years so this was not an option for either of us.

We have now realised that we got this wrong- I was on a spa day on that particular day.

Do we tell them about the error? DH already has 6 points so this will push him to 9 but I also know that we have to be honest. DH Is very worried about having 9 points. I only have these 3 but I am uncomfortable with lying.

Honestly I wouldn't worry about telling them but I would strongly encourage you both to stop driving, if you can't stop speeding! You've both been caught in the last 3 years, your husband has 6 points and yet neither of you seem able to keep to the limit!

Neither of you have learnt your lesson from the course so maybe losing your licences will help?

Both had a course plus 12 points between you is terrible!

We had a similar thing. Both in the car but couldn’t remember who drove and couldn’t see on picture. Dh took it but it could have been me. Leave it it’s done.

Have you told anyone about this error? If you have you need to be 100% sure that they will never tell anyone else. If you have told a few people I would write to the courts and ask them what to do. If just the two of you know, keep schtum.

Didn’t he pay attention on his speed awareness course? I wouldn’t dwell on this, but your dh needs to be much more careful about observing the speed limit in future. I would tell him you’re not taking the rap for him again (even though it was unintentional this time).

I think it'll only complicate things and I'm not sure they'd believe that you'd forget something prominent like a spa event.

Take the hit, and moving forward sounds like both of you need to be a bit more careful.

Come clean about the mistake. Your husband was speeding, he should take the points. Don’t feel sorry for him, he deserves to be worried.

Just as an aside, those of us that own cars need to know who is driving them and when. Especially if you have a household with parents and maybe a couple of teenagers or young adults driving your car too. You can’t just leave keys on a hook for anyone to pick up and take them. Ask yourself what you would do if everyone denied being the driver in your household if a notice of intended prosecution came through the post.

Hmm - you sure you made a mistake? You forgot you went for a spa day? And didn't check your emails or your calendar. The cynic in me thinks you're worried your actual whereabouts may be cross-referenced in some way because you decided between you that you would take the points.

In that situation the registered keeper could be guilty of another offence. 🥶
You can request photos but not always helpful.

It is the responsibility of the last known registered keeper of the vehicle to provide details of who was driving at the time of the alleged offence. Failure to do so could result in a fine.
If you do not know who was driving then you should contact the Central Ticket Office of the force concerned who will advise you what action to take as policy may vary from force to force. Photographic evidence (if available) may resolve the issue.
If it is a company vehicle and no driver can be identified then it may be the company secretary/director who is prosecuted for failure to furnish driver details. A company may argue that they don't keep records of who drives their vehicles so the required information cannot be supplied. However, any such argument will fail at court unless the company can prove not only that it doesn't keep records but also that failing to keep records is reasonable in the circumstances.

I suspect this too. OP knows it was her husband and they decided between them that she will take the points, and now she's regretting it and wondering if they'll be caught.

Apologies if that is not case @cheesenpickel but whatever has happened, you would be better off just keeping quiet now.

Not if it was a booked spa day! It would be in your diary/phone calendar.

Also, you can easily look at your phone calendar to see other things you have been doing/had booked, and you can look at Google Maps or your FitBit or something on your phone. The vast majority of the time I can tell anyone where I was on any given day by looking at my phone.

Not if I were at a spa day which I would imagine isn't a very common occurrence.

It does rather look like you've decided to say it was you because he has more points. Personally as I said above I would encourage you to both stop driving!

We had this but we were in holiday and both in the car at the time so we didn’t remember. The letter and a subsequent letter got lost in the post so it went to court. DH took the points and we paid the fine together.
