Someone blamed DH for car damage he did not cause

Someone left a note at DHs car saying that they assume he bumped into their car. They also said they assume it was him because they found a corresponding damage on his car (which was parked right behind theirs). This categorically didn’t happen, DHs car had not been moved during the time in question, and I know that this damage had been there already - he bought the car used a couple months ago. DH called the number on the note to say that it wasn’t him, but they still reported it to their insurance and named him as the guilty party. His insurance asked for proof how the damage on his car occurred but he can’t provide this because it was there already when he bought the car, it’s a small bump and he just hasn’t bothered fixing it. What shall we do?

Any images of the car from when you bought it? Find the ad, look for any photos that might have captured the damage and where it shows up in the background.

Anything at all that shows it predates the incident?

Is the area covered by cameras? Ring doorbells? Anything to show which car came and went in what order.

Go to the person he bought the car from for evidence that it was there when he purchased the car?

We looked through photos of the car but it isn’t visible and the ad is not online anymore. It wasn’t parked in our street so we’d need to knock on strangers doors to ask for their ring footage but it seems a bit extreme?

Can you contact the person who sold it you and ask if they still have the pictures from when they sold it

Yes, I suggested that to DH but he thinks it’s not reasonable to bother the seller as the sale is complete and DH thinks this is not their issue.
Can the other party do something without having proof? Do we need to proof that it didn’t happen, or do they need to proof that it happened? I was hoping it’s something like ‘innocent until proven guilty’

Exactly the same thing happened to my daughter . Luckily she was able to provide photos from the ad from when she bought the car with the marks and scrapes etc documented . The insurance company were happy with that and closed the claim. It has however ridiculously put her premiums up . When we argue that there was no claim they say it’s classed as notification only but still incrues an increase it premiums . We argued that it’s not a notification it was mistaken identity , they won’t listen though. It seems once something is reported even if it wasn’t you it’s going to affect your premiums . Madness

Just let the insurance company deal with it. Drivers can't admit liability or apportion blame anyway. It won't go anywhere. You need proof in court, and without witnesses there isnt any. Just don't stress. Does your car have an app by any chance. Mine shows the journey and engine on and off times. So, if it was me, I'd be able to prove that my car wasn't in use at the time.

Can he prove he was elsewhere, ie, in work etc?
