Mattress was damaged in transit - who should pay return costs?

I ordered a cot bed mattress online but it was damaged in transit and so I need an exchange.

Does anyone know what the legal position is in terms of:

  • should the retailer collect it from my house?
  • can they make me pay for the return costs?
  • should the refund my original delivery charge - I also paid extra for named day delivery.

What do the company’s terms and conditions say about returns?

Retailer should arrange and pay as the item is damaged and not fit for purpose, it's different if you'd changed your mind. If they're replacing it then I'd expect to not receive a delivery fee refund, if your getting a refund and buying elsewhere then yes you should get your delivery fee back too.
