Hi moms! I have been involved in car accident 2 years ago! Was dropping my child to school, while i was trying to reverse back, checked my blind spots and having camera at the back, another car hit at the back while he tried to park between my car in other! Im surprised he didn’t used rule parallel parking,he just went into my car! He came out apologised, saying because same school to manage friendly, like me to fixed my car he will fixed his car not to involve insurance! Anyway i felt sorry for him , didnt want to make big deal just pain came off cost me £100!After 2 days he texted me asking because he says i accept is my fault, to pay him £1500cash! His car doesn’t cost so much money, old car 2006 with a lot scratches!I was shocked obviously how he started to play games with meand be aggressive, i told we deal through insurance! I did manage to get cctv from one of houses around! Last year claim was closed,i was happy im ok! Today surprise phone call from my insurance , the guy did reopen claim! And now they saying 50-50! I dont feel it was my fault, how many people saw this video everyone says is his fault! Even didnt stop before or indicating! Insurance says me because we are both moving and under highway code 202 rule! Plus now he is trying for body injury aswell! Wth people are doing for money, was no speed, no ambulance, he was perfectly fine! Thank you for any advice

In that case I retract what I said about parking in front of a truck, it was because in your OP you said "Was dropping my child to school, while i was trying to reverse" that I thought you had just arrived when the accident took place, and not that you were in the process of leaving.

You need to phone your insurance provider when they are next open and ask if anything has changed on the case. Call the phone number provided on your original proof of insurance. If this is genuine then they will be able to explain what is happening.

It's against the Highway Code to park against the flow of traffic but there's no law to say you must parallel park when parking. It's always safer to go through insurance, I'm sure they will look into it thoroughly. They don't cough-up unless they absolutely have too.

@Bonniethetiler when we arrived with little one was no truck.I did wait to see how is in going to the class, chatting with other parent’s and teacher.And truck came and parked in front of me(my luck😢) When i was preparing to leave was already closing time of gates. I just can think he was in rush the driver, on cctv you can see time was 08:59:38. Gates are closing at 9

I used to work in car insurance dealing with liability claims.
An incident like this would be decided as 50/50 as regards to the vehicle damage: you were both moving at the time of the impact, neither had right of way and there is no legal requirement for the other party to reverse park.
If you feel an injury claim is exaggerated, speak to your insurers and advise what approx speed you were travelling at. Just because he’s claiming, doesn’t mean they will pay that part.

@HollyBerryz from today email insurance :The highway code states:

Rule 202
Look carefully before you start reversing. You should

  • use all your mirrors
  • check the ‘blind spot’ behind you (the part of the road you cannot see easily in the mirrors)
  • check there are no pedestrians (particularly children), cyclists, other road users or obstructions in the road behind you.
Reverse slowly while
  • checking all around
  • looking mainly through the rear window
  • being aware that the front of your vehicle will swing out as you turn.
wich i do feel and know i done this🤕

May I respectfully say I totally get this whole situation is upsetting and you feel you did everything right, but they haven’t done anything spectacularly wrong. It is purely and simply an accident and they do happen sadly.

I don’t need to see the video, it wouldn’t change the liability. You can’t argue anyone is speeding or driving recklessly. It is purely and simply an accident.
Ring your insurers tomorrow. Tell
them you understand about liability. Tell them about the low speed impact regarding the injury claim and let them have the video. Tell them how upsetting this all is and that you would like them to deal with it as they see fit and leave you alone and just notify you when settled. It’s irrelevant whether he claims £50 or £5000 to be honest. A statement from him would make no difference. There was fault on both sides. The insurers will independently assess costs claimed for and will not pay more than they see fit.
You pay insurance premiums for someone else to do the work for you. Let them.
I’ve been in a high speed multi car accident on the motorway before. I understand all the stress first hand. But the insurer is paid by you to deal with it. Your feelings are valid but try and move past this.

Why worry? You are insured and the insurers will sort this out.
