CMS and domestic violence

Hi

can anyone advise me on this, if you contact cms to collect payments for your child and you were a victim of domestic violence, do the cms ask for proof of dv ? Or do they take your word for it and not pass on confidential information ?

CMS is for non resident parents to contribute to their kid's upbringing. It has nothing at all to do with the reasons for separation, including dv.

You can't opt into the collect and pay until they have missed payments.

I can't remember the details but I know when I first set up CMS where we were living was not known to my abusive ex so it must have been possible or I would not have done it. It was social services that gave him my address in the end

They won't provide him with your address you will just need to provide bank details for direct pay (which is best as no fees taken off.) He won't see any of your personal details and will have a separate login and account home page so nothing will be shared. Don't let that fear put you off claiming x

It has really put me off claiming, it’s been over 5 years since me and my child saw him we had to flee and move away. I was just so scared in case he found us again

Will cms automatically take the payments out of his account or does he pay via a log in page?

He should set up a standing order to pay you monthly via his bank. If he doesn't pay then you report it through cms. There's a page for you to provide your sort code and account number. I can assure you there's no direct contact and your letters are not visible to him and vice versa. So there's no direct contact or personal info given away so please do make a claim x

And I'm really sorry to hear that. I didn't mean to be so matter of fact I just wanted to give you the information! Similar situation to Mr and I made a claim recently and no information was given to him x

They had to give my abusive ex a chance to pay himself before they added the costs. He didn’t pay properly so it went to collect and pay. But unfortunately despite being a victim of dv, they still are allowed the opportunity to pay themselves. I’m going through tribunal at the moment and I’ve ensured the entire time my address withheld from him. If you don’t want your bank details shared, could you open an entire separate account just for the sole purpose of Cms use and transfer it after to your main account? I wish you the best

they ask if you have been subjected to abuse in application form and then list helpful numbers for abuse support. they don't add anything on your case notes. you can request with your bank that your location is not shown eg your sorting code so as not to reveal your location. if he is stalking or being abusive you can file for a non molestation order which makes him stay away from you
