Purchased table but free chairs not given!

We moved house 3 weeks ago and as part of the purchase we bought various objects including a dining table. The seller said chairs were free and were listed as free in the PIF.

When we moved in we have this huge beautiful table and no chairs!

I looked back at the documentation and then table and chairs were listed separately the table £100 and the chairs as free.

We went round to inspect the items and the seller said they would leave free of charge some wardrobes not listed in the PIF

I then emailed stating what we wished to purchase about 10 items including the table. I did not include the chairs in this email.

So we have the free wardrobes but not the free chairs.

I thought it was my error due to the ambiguity of the chairs being free but I still think it's totally unreasonable of the seller to leave a dining table and no chairs. I'm getting more and more irritated by the useless table.

Should I email My solicitor? Is it too late?

Well yes, you can ask and take it to your solicitor, or you can shrug and go get some from market place.

I didn't message the first day because i didn't include them in the email I sent of the contents we wanted to purchase.

I wrote it off as my mistake

The table is beautiful but it is not to our taste and was a stop gap.

Now I am getting more and more irritated by the lack of chairs.

You did not specify chair too so they did not leave them. If they did you could be asking them to remove them.

This is nonsense. You don’t specify things you want if they are already listed in the sale.
The chairs were included. The OP didn’t and shouldn’t have included them in her list of extras she wanted to buy. The sellers are wrong here but the OP should have asked for them to be brought back on the day she moved in.

If they were “free” then they were included in the sale price so had actually been bought by the OP.

They were listed on the PIF as "free" not included

The kitchen table was "included"

The wardrobes were not listed at all and left.

Sorry but I also think if you wanted the chairs you should have specified that as it’s open to misinterpretation. I’m assuming as you didn’t specifically ask, they assumed you just wanted the table

I don't think you should, be getting irritated, no matter how annoying it is! Sounds like a genuine miscommunication. You indicated what you wanted but didn't mention the chairs (because you assumed they'd be left behind for free)
The seller saw what you wanted, and has assumed you didn't want the chairs because they weren't listed.
I think you've both made assumptions and it's gone pear shaped. Could you email the buyer and see if they still have them?
Total ballache for you, I completely get that, but unfortunately miscommunication shit happens!

I've just emailed the solicitor and basically there is no point it's not a legal issue after completion and what are the chances of getting them back.

I think I sat down the day after moving to email And realised it was my mistake.

I think they went to the sale room, they were downsizing. It is annoying and it is my fault I just hoped there'd be a loophole!

I didn't assume I would get them for free but in forgot to or didn't occur to me to specify them in my email. So it is totally on me and DH who verifies things.

It's still really annoying and she could have left the free chairs.

If it's just a stop gap, have a look on your local Gumtree or FB Marketplace for chairs, there's normally loads on there this time of year.

It sounds like a miscommunication, if you'd contacted them on the day you moved in, they might have been able to get them back. When we bought our house the seller left loads of furniture which wasn't listed in the itinery. It was really irritating as we had nowhere to put our own furniture!

This is why in have only just chased it - clutching at straws!

They won't have them will have gone to the auction room with the rest of the furniture.

I may try the auction room.

Also I don't want to contact them they were a bit of a difficult person. It was a very sad situation too for them.

Thing is though if they left the free chairs anyway and then it turned out you didn’t want them as hadn’t specified them on the form then they would have to come back to collect. They did the sensible thing here and followed your instructions as to what you wanted.

Sellers have had to pay penalties in the past for leaving stuff behind that the vendors have to deal with. Your sellers didn't know you wanted the chairs so from their point of view they got rid of them for you.

If the table is a stopgap I'm sure you can find some stopgap chairs very cheaply or even free - try freecycle or local Facebook groups/marketplace

I agree they followed those instructions but they left a whole suite of bedroom furniture in the basis of a verbal discussion. So therefore that doesn't add up.

It's just one of those things. Thanks for all the feedback though it's helps with the different views!

Happily the other annoying thing was that I lost my coat on moving day and I have now found it today.

Yes it's a beautiful table but it huge a bit dated for us. We have chairs from the other room and some folding spare chairs we can use it's just a shame we don't have the set as it would be lovely

We are happy on the whole!
