I ordered an item (pair of silver earrings). I needed them by a specific date, for an event. They arrived from the company but were gold instead of silver - so the company sending them made a mistake. I contacted the company asking to return them. In the meantime I bought a second pair of earrings elsewhere as I needed them for a specific date.

the company are now refusing to offer me a refund, and will only exchange instead. Am I entitled to a refund? What can I say to them?

Googling The Consumer act 2015 it looks like you should get a full refund from the retailer as the good were not sold as described but I am no expert, citizens advice may hel p

Yes they should give you a refund because they were bought online and the item you received wasn't as described. (Earrings are usually excluded from this for hygiene reasons but you aren't returning because you've changed your mind, you're returning because the item wasn't as described).

Distance selling regulations give you 14 days to notify that you are rejecting goods and further time to return them. How long after delivery did you do so?

Earrings delivered on 17 November so all very recent. Thanks all!

Distance selling regulations were replaced, however as they have (in error) substituted an item without informing you before sending them you should be able to return with them footing the bill for postage.
