To think this policy is ridiculous?

Made an order at an online store. When I went on the site I got their pop up giving 15% off first order. Great I thought!
It kept popping up ... every page... really heavily advertising this offer.

anyway

Order arrives and everything is just bloody massive. I'm not slim and I'd have I guess even a few sizes down would still swamp me so the clothes are just unsuitable. Made me look alot bigger the 'style'

Then it turns out your not entitled to a refund if you used any code including welcome code!! If I didn't use the code I could of had a refund?!!!! (Items orginally was full price not sale) Now I'm stuck with store credit essentially at a tent store ... dammit .... I know I should have read better but feels like they give this discount as abit of a con .

Thoughts On a policy like this?

Is the cooling off period 7 or 14 days now? Either way within that time frame you're entitled to a refund, though may have to pay return postage. No excuses from the retailer.

Sorry should of said I'm in Australia ... forgot about differing laws for online selling.

If the policy is legal in Australia then you're buggered, I agree it is sneaky but you have to read the small print.

That's illegal in the UK. Distance selling rules say you have the right of return.

Phone them and tell them you will be returning the goods, ask for a returns number and if they refuse, tell them you will report them to trading standards immediately. Gov link here.

Can you go back on the site and get the popup again? Read everything including the terms thoroughly. Australian distance selling law says retailers must not:

not mislead you or hide costs and other details from you

Even if it states it somewhere but it's buried, it might be worth quoting this to them that it wasn't clear when ordering.

Spoke to them today and pleased to be considered for refund . It's a small place with not a lot of items (lots out of stock even in my size!) and they just said buy something with the credit and try to sell it if nothing suits my body type!!!!
I just feel it's pretty shady to give people discounts to basicly take away their rights :( it's almost a trick. I'd understand final sale but these were full price items.
equivalent to £100 down the drain!

This, kick up a stink on SM, copy in any consumer watch dog type organisations etc.
Point out that they need to make their policy very clear rather than tricking people into this situation.

I have opened a PayPal case in hope they can help me (paid through there) next resort is socials / review.
just saw a lot of people complaining about the same thing on reviews eeek!

Have attached this an example what they sent to me email aswell as pop ups for using a welcome offer- nothing about how it effects your rights if used!
