Will I actually get any refund?

Stupidly taken in by one of those scammy websites that always appear top of the google search page when you're actually wanting the official government website.

I'm normally really good at checking, but it was late and I was doing this over Dds shoulder. Realised within seconds as my phone popped up say £115 rather than £34 had been taken.

I'll post my many emails below

Mainly posting to remind others to please triple check you're on the official site when applying for passports, driving license etc. some of these sites really do look like the real thing and unfortunately and unbelievably are perfectly legal!

I've finally been offered 90% of my payment back, which I've accepted to avoid any further hassle, will see if it actually turns up.

My many emails:

My daughter has applied for her provisional license thinking you were the official government website using my bank card.

She only saw the large text stating the £34 fee and not the much smaller text stating the £81 additional fee your website has also taken.

We do not require your additional services and see this as a scam. My daughter is only 16 years of age.

Please refund the money with immediate effect so we can go through the official government website.

As an addition to my previous email, please note my request to not proceed with your service was made only 20 minutes after the initial transaction, on a bank holiday, in the evening, so the process will not have been started yet on your side.

Further to my previous two emails, I refer to the Consumer Contracts Regulations 2013 (CCR 2013) which states you have 14 days from entering a service contract in which you can cancel it.

Late on a bank holiday you will not have started the process yet, and I expect a full refund of £115 without delay. I have also reported the matter to my bank.

Further to my previous three emails regarding my 16 year old daughter mistaking your website for the official Government website, I have now completed the application for her myself using the official site.

This means you will be unable to start the process and under the Consumer Contracts Regulations 2013 (CCR 2013) I request a full refund of £115.

Under the Consumer Contracts Regulations 2013 (CCR 2013) I request a FULL refund of £115 to which I am legally entitled.

As stated previously you will have been unable to start the process as I have already now completed the process myself, and the DVLA do not allow you to do it more than once.
If I do not receive a refund I will contact action fraud. I have already contacted my bank who are waiting to see how you proceed.

In addition to my below emails, the payment is still pending, so hasn't left my account yet, please void the payment. You haven't yet provided any service, and as I have already applied myself via the DVLA official website you will be unable to provide any service. Also, once I have received a full refund, I exercise my 'right to erasure' and request you delete any personal details you hold for my daughter or myself.

I do not accept your offer of a £58 refund, I am legally within my rights to a full refund as I am within 14 days of having signed up, please see the table below relating to my consumer rights and online distance selling. I don't need your service, I have already completed everything myself on the official government website. I look forward to receiving my FULL refund in accordance with my rights.

I am legally entitled to a FULL refund, however, as I'm sure your company is aware I really can't be bothered pursuing this any further, my time and effort is worth more than the £12 your company is scamming me.
Please refund the agreed £103 with immediate effect.
