  1. If you are arrested, then bailed, then charges dropped do you legally have a "criminal record"?
  1. Is a community order warning (not notice, warning) a criminal record?
  1. If you attend a voluntary interview is this a criminal record?

  1. No. As per the justice system you are innocent until proven guilty in a court of law.

  2. No you won't flag as having a criminal record however your information is stored by the police so far as I'm aware, so that it can be accessed if you're arrested again.

No to all of these BUT if you have to have a DBS, there is a broad ranging final section on “local intelligence” which in theory can include these matters. There’s been case law around it and the discretion involved, so a disclosure on this section would likely only be made in extreme circumstances eg if a DBS was a role working children and the intelligence related to a serious accusation directly involving children. If there is likely to be a disclosure made in this section I think they have to give you a chance to make representations as to why it shouldn’t etc first.

That should say an enhanced DBS, rather than a basic check - ie to work with children and vulnerable adults.

Excellent, that's what I thought. Just trying to get some things clear in my head as dh keeps accusing me of giving him a criminal record.
If he, for example, gets pulled over for a traffic stop, hisnplayes run etc, will these things show up?
He is going on and in about it, blaming me and expects me to just believe what he says as he is a former police officer (decades ago)
