Parking appeal rejected

Just looking for advice from anyone else in the same boat. I received a parking charge notice and appealed it, but have had the appeal rejected by the council. The next step is to take it to the adjudicator, which I want to do as I feel it was unfairly issued, but what is stopping me is that I have to wait for the council to send me another letter, at which point the fine will be £90.
Has anyone else taken a parking ticket further in this way? Just thinking that I should just pay the £30.
I'm in Scotland if that makes a difference legally.

Why do you think it was unfairly issued? What grounds do you have for appeal?

Have you spoken to citizen's advice yet? They really helped me when I appealed against paying an unpaid debt and they presented a court summons (also Scotland)

What are the grounds of appeal?

Thanks! The ticket hadn't been printed when I got back to my car, so the process should have been cancelled (I used to work in parking in Edinburgh so know this). It has to be handed to the driver or placed on the car. She put it on the car while I was in the middle of driving away.

What was it for? Overstaying or you didn't have a ticket?

So your argument is that you got back in the car and started the engine before her machine printed the ticket?

Pay the fine - there's no guarantee you'll win that.

On what grounds was it unfairly issued? Was it just because you were driving away? Is there cctv?

But why was she printing a ticket for you? That's the real question.

So you saw her printing the ticket and started moving your car and she stuck the ticket on your car whilst you were driving off;

You did this because you know that the ticket needs to be on the car and thought you will get away with it
You must have been driving very slow for her to put the ticket on your car so you were just trying to get away from her really

If they've issued the PCN but not placed on the car, they can send it to your home address from your reg number.

She put in on the car so it counts. Sounds like you were parked somewhere you shouldn't have been as well. Just pay it, you were in the wrong

It was placed on your car and the photographs would have already been taken, so I don't think you will win.

Just take the £30 on the chin and don't park where you shouldn't/outstay your ticket next time.

I won after nearly 9months of going back and forth !
I bought a ticket using parking app so had no physical ticket !
I proved I bought ticket with evidence!
Then they said they are upholding penalty because I put in a zero instead of a o !
I send it to adjudication and won the case !!

So you were parked somewhere you shouldn't be, you knew this and tried to move before she gave you the ticket to get out of paying it?

And you think you're in the right? 🤔

I'd personally pay the fine now before it becomes more and in future don't park where you shouldn't be

@Hairobsessed123 - yours sounds like you had intended to do everything correctly though. OP is trying to get out of it because she drove off mid ticket being issued Given she hasn’t said the issuing of the ticket itself was incorrect I assume she had parked illegally/overstayed.

They can't stop the process once started because that leaves them open to being bribed or accused of taking bribes. Also I think the belief that they have to stick the ticket on your car before you start the engine is a myth. They'll have your details and the ticket will still be issued.

I used to work in parking as well and I think you will lose this appeal, you are better off paying this.

I hope you lose the appeal if you didn't buy a ticket.

If you overstayed by just a minute or two that's understandable.

Nah she deserves the fine for attempting to drive away whilst the warden was applying the ticket. That's dangerous.
