Bank Holiday entitlement for PT workers

SlightlyDefective · 04/05/2021 19:41

Hi,

My colleague and I both work 3 days per week and so our holiday entitlement (including Bh) is 3/5 of our full time colleagues. This seems about right as we both work the same amount of days per week. I however, work Mondays and she doesn’t. This means that I need to use my holiday entitlement for each bank holiday Monday (and as I am part time, I don’t get the full entitlement, but have to use 7 days holiday) that occurs through the year, and she obviously does not. Is it just my bad luck that I work Mondays?

I have NEVER had a bank holiday taken out of my annual leave. Confused

HunterHearstHelmsley · 04/05/2021 21:06

Its quite simple really.

Minimum annual leave is 5.6 weeks (28 days- 20 days "holiday" and 8 Bank Holidays). Nobody should be getting more or less because of the days they work. However, if they don't work Bank Holidays then that entitlement can be used elsewhere.

E.G - Barbara works Monday, Tuesday, Wednesday and Mary works Tuesday, Wednesday, Thursday. Each is entitled to 16.8 days holiday (or 126 hours assuming a 7.5 hour day) Using 2019/2020 as an example, 5 Bank Holidays fall MTW and 1 falls TWT. Barbara needs 37.5 hours of her holiday entitlement to book the Bank Holidays, leaving 88.5 hours to book where she likes. Mary only has to use 7.5 hours for Bank Holidays meaning she has 118.5 hours to book where she likes.

Each work the same hours and have the same amount of holiday. Mary just has more freedom about when she takes it.

part timers where I work used to accrue holiday on the hours we worked, but it was an HR nightmare (especially for people like me that worked 5 hours on a weekday, but 7,5 on a weekend) so they scrapped that and worked out holiday entitlement per day!

I would find that very unusual.

I get 30 days leave a year. Officially, I get 38. If I log onto our HR system, it shows something like "BH adjustment-1". I might not know I've used it but I have.

I hate working out part time holiday entitlement. It's so painful.

Sunny1112 · 04/05/2021 21:20

I’m another who doesn’t use AL for bank hols!

Full time or part time?

You probably do use it. It's just never "given" to you.

How is it accounted for then? Is it split into leave and bank holidays and treated separately?

Some companies lump them together within the 28 days minimum and other have them in addition to standard annual leave. However it is done part time staff should not get a worse deal than full time staff

Sunny1112 · 04/05/2021 21:40

@HunterHearstHelmsley I’m part time.
The days I get are worked out correctly for the hours I do.

Groovee · 04/05/2021 21:41

I work term time only. I had to pay my jobshare back 2 days so she got 2 days off and I worked those.

Sinner10 · 04/05/2021 21:45

I work Mon to Weds and I can’t say it bothers me at all. You’re thinking more into it because a colleague works different days. Plus there are not 7 bank holidays on a Monday. Surely 3 or 4 fall on your colleagues working days as well?

Sinner10 · 04/05/2021 21:47

Also I often have a bank holiday day or two to use when I please.

Ugzbugz · 04/05/2021 21:52

Have you checked here
www.gov.uk/calculate-your-holiday-entitlement

At my work you deducted or added days and it worked out all different due to xmas etc

modgepodge · 04/05/2021 22:02

I’m part time, Monday- Thursday. I didn’t go to work yesterday. No one has suggested I am only entitled to4/5 of it? I guess people who don’t work Mondays don’t benefit from that bank holiday. I’m a teacher though, so a) no annual leave entitlement, we all have the same dates off, and b) there’s usually only 1 BH per year which isn’t during school holidays anyway. Maybe that’s why it’s different? Have to say I find the whole thread very confusing.

Soontobe60 · 04/05/2021 22:11

I just tried to write a post about the different permutations, but it’s to complicated so I gave up! The solution? Don’t work on Mondays!

qualitygirl · 04/05/2021 22:19

@dementedpixie I get 27days, I get paid for 9 bank hols/public hols. I can also work up another weeks worth of leave, and I can buy a week at the start of the year.

Anyone in my workplace who works shift and just so happens to have their hours fall on a bank holiday gets double time and an extra days holiday and I'm 95% sure that even if your shift doesn't fall on the bank holiday you still get the extra days leave.

dementedpixie · 04/05/2021 22:25

Your employer offers far over and above the minimum then. Do you get 27 + 9 days = 36 days?
Think of it as 36 days annual leave in total and when you are off on a bank holiday a day is deducted from that 36

FunnysInLaJardin · 04/05/2021 22:28

Well, that doesn't sound quite right. I am part time and get 25 days holiday a year, but get all bank holidays in addition. I would be very annoyed if I had to take my holiday for a bank holiday!

qualitygirl · 04/05/2021 22:30

@dementedpixie
I suppose if you want to think of it that way but there's no point in going around the long way...we just get paid for bank holidays 🤷‍♀️ our annual leave on the system is-
Annual leave- 243 hrs
Time for time earned- 39hours
Buy a week- 39hours

qualitygirl · 04/05/2021 22:32

And I actually forgot you can carry over hours too... can't remember how many though because I never do.

SlightlyDefective · 04/05/2021 22:44

Holiday allowance for part timers where I work is calculated by taking what a full timer is entitled to eg - 23 days hol and 8 bh and then working it out in comparison so full time would get 31 days hol including bank holidays and I would get 25 days including banks holiday as I work 3 days compared to 5 days. That all seems fair enough to me, i am just a little miffed that she gets she is able to book more time off during the summer hols whilst I pay out for childcare. It’s not her fault at all, it’s just bad luck that I work Mondays..... and I can’t imagine that she will want to swap with me!!... ever!! 😂
