Neighbour using wheelie bin

Would you be annoyed if neighbour used your wheelie bin?
Just gone to mine and bag been put in that has meant top
Left up so something has got to bag and scratched it open so can see contents are not ours
Bins due friday and now not room for my own bag
Dh says leave it maybe one off where as I want to say something
Its bad enough they leave there 2 bins full to brim with lid up so cats or whatever get it.
We only have the one bin they have 2 , other neighbour has one but lives on own so its never full plus she keeps in her garden as its bigger than our ones and level , ours has steps so getting bin in is hard which is why we and neighbours leave in a bin area .
I don't think its an error as our bin has number on top and side.
If it was bin day and we had room and they asked I would have no problem.
So do I leave it this time or say something ( maybe just by a lock if such thing exsists)

Yes I’d be annoyed. Also they say they won’t empty our bins if the lid isn’t closed properly or if you put recyclables in the grey bin.

Dh says he will go out later and remove bag and re bag and put in top of their bin , then I will mention that we removed it as we couldn't get ours in.

Technically speaking it's fly-tipping and against the law (not that the police would concern themselves with it). Get a bin lock and give them disappointed looks when you see them. If you or your husband can get in the bin and push the rubbish down a bit you'll probably be able to fit your other bag in, or ask your nice neighbour if you can put it in hers this once.
