Private road and right of way

How do you find out if a road is a right of way? It’s a private road. Go to the council or something to do with the land registry? Or would it definitely not be? You can have rights of way over private land though can’t you?

Our council are a bit rubbish so if I go to them I need to know what I’m asking, which I don’t really. And I can’t find what to look at on the land registry.

You need to check an OS map, or otherwise look it up on the Definitive Map (ask your council’s Rights of Way dept when you can book in to view it. It’s free to do so).

Thank you so much! I’m looking at OS maps online now but I’m not sure it’s showing rights of way - it doesn’t show lots of bike routes which are definitely rights of way. I’ll give the council an email if that’s the best route then? And hear back some time next year..

Apparently we don’t have a definitive map because we’re in london.. any other ideas?

The deeds for the land / property / properties which own/s the private road will detail any rights of way. You can get these from the land registry for about £7.
