Returning to work from maternity and then going of again for another maternity

Hi i wanted to ask the basic rights of an individual who has had a baby so went on maternity leave in march. Now i am expecting again and due again in march. I would like to know how many weeks i would need to work again to get maternity leave or werher i am entitled to mat leav again or not.

You will be entitled to Mat leave. Mat pay depends on wages between weeks 17-25 of pregnancy as that's the test period. In that period this needs to be true:

Statutory Maternity Pay (SMP)

To qualify forSMPyou must:

  • earn on average at least £118 a week
  • give thecorrect notice
  • giveproof you’re pregnant
  • have worked for your employercontinuouslyfor at least 26 weeks continuing into the ‘qualifying week’ - the 15th week before the expected week of childbirth

Not sure how it's all changed now but about 10 years ago this happened to a woman I worked with. She went on maternity leave for one then used up all her holiday to bridge the gap between coming back and going on maternity leave again.

Thanks for your responses. Does this mean if i work 15 full weeks before having another baby I can be entitled to mat leave and pay?

Will you be at work between week 17 and 25 of pregnancy? That is the test period for qualifying for mat pay. You are entitled to leave already but need to qualify for pay.

Or will you still be getting mat pay in those weeks as that would count too

I am currently on week 24 and have started work this week. So in total planning to work 16 weeks till next baby is due.

You are entitled to a second mat leave. You will not qualify for SMP as you've not worked in the right weeks of this second pregnancy. You may qualify for MA but would need to look at the guidance. I fear not but I don't know exactly when you stopped working before baby 1.

Were you on unpaid maternity leave before going back or were you still getting maternity pay? You may have to claim maternity allowance instead

I was currently on statutory maternity pay and ocupational pay . It would have ended in december.

So were you getting money from that maternity pay from week 17 until you started back this week? If so then you may qualify for SMP if it was over £118 a week you were receiving. You would need to check with your employer whether they would pay the occupational pay too.

Yes and yes was getting paid over £118 a week on smp.
