Fed up with Apple. What would you do in this situation?

My Iphone 7 got wet in february and broke despite being advertised as being waterproof and able to withstand 3 foot of water (apparently only for the first few months!).
After some arguing they sent me a new phone. That phone is now not letting me hear phonecalls depaite speakers working in other ways.
Apple are saying they will repair it but it that the warrently runs from the phones original purchase so has run out. I will have to pay but they can't say how much. We don't really have the money for me to turn up and accept whatever charge they throw at me and in my opinion a 5 month old phone should be covered!
DH is saying to argue with them on chat until they agree to do it for free. I am not really comfortable with it but cannot keep on with a phone that doesn't work!
What would you do? I plan to stop buying from apple as soon as I can afford but for now, would you argue or accept that it has no warrenty?

Have you been to a Genius Bar? I dropped mine in a toilet and they very kindly gave me a new one. It didn’t come with a new warranty though they were clear on that.

They are in the Apple stores, you can make appointments on line and they can look at your phone (however old it is) and tell you why it’s not working and how much to fix it they might try to fix it for you. I’ve always found them the service great. Much better than the phone provider

This is what has been arranged. Problem with this is we don't have much money so I can't just pay whatever they say if they diagnose it ( a battery is £65 so probably looking at £100+) and will have to go to the next city with kids in tow to get it done.
DH is saying the phone was new and so should be replaced and I should argue it. They are saying yes it is new, but was a replacement so not under warrenty. I don't know whether to argue it or not?

Your husband is wrong, the warranty runs from when you purchased the phone. How old is it?

Did you buy the phone from Apple originally? You could argue that the phone is inherently faulty under your statutory rights, but you'd need an independent expert report to confirm it, and for any remedy they're allowed to make a reduction to take into account the age of the phone.

Bought the phone in September but not from Apple so it was considered 5 months old before it even got out the box.
DH would happily have dealt with it but he is out and I have had both kids to tend to whilst sorting this out.

Who did you buy it from? If new from a shop ie. Currys then your 1 year warranty is from them.

Because I bought it from someone on eBay not apple themselves. They bought the phone in May which means the warranty went in May even though it wasn’t activated at all until September.

This is going to sound ridiculous, but have you tried hard resetting your phone? My partners done this and it somehow worked again. We could've just been lucky though!

Yes and at first it worked but I have had to turn it on and off again about 5 times this week and it has stopped working again.

I used to deal with this sort of thing at work ..legally the warranty is a condition of sale so runs from when you purchase the original item, you don’t start the clock again from when you get a repair or replacement. They also only have to put you back to where you were so could make any replacement a refurbished item rather than a brand new one.

The above only applies to ‘warranty’ items ie if you’ve damaged it then you probably won’t qualify for a free replacement. Any repair may also come with its own ‘parts’ or ‘parts and labour’ guarantee generally of 3-6 months.

Is it one of the models with a headphone socket? Probably not, but just in case,... I had a similar problem and it was due to a build up of dust in the headphone socket - the phone thought there was a headphone plugged in so wouldn’t play calls through the usual hole for phone calls but the speaker still worked fine for music. Once I cleaned it out with a. Toothpick it worked again. Sorry if yours doesn’t have an old style headphone socket :-)

Notageek - I was pretty sure that was the case and I am pretty sure DH knows it too. He would argue with them anyway to see if they gave in and did for free. I am not comfortable with it though but also cannot afford it if the cost is high.
I bloody hate that these phones are so expensive!

If you visit the Genius Bar they will have a look at it and then give you a cost for fixing it - you aren't committed to it unless you say go ahead and fix it.

Even then Oreo - I will have spent a whole day and a train trip for me and Ds to get there and find I am no better off. It is so shit. These phones cost hundreds of pound but are made for pennies. Apple are robbing bastards! I think I am just going to try and trade it in for another phone at C.warehouse. It will probably be cheaper!
