AS others have said if it is advertised as "women only" then it can only be for biological females. (In fact this was always true).

The Supreme Court ruling just makes clear that despite the assault of the English Language, the word women always did mean biological females.

So either to comply with the law if they are calling it for women then they can only allow biological women to attend.

If they want it open to those who identify as women, and have for instance a GRC then they need to make that clear.

NB those who identify and are not seeking a GRC are not covered eg those claiming they are non binary, or gender fluid.

If they are to be included then it isn't a service for women. It is a mixed sex trauma support service.

Is this part of the service funded by a particular stream of money, or funder.

Even if the source of this money has insisted it should be trans inclusive it can not be advertised or listed as women only.

From another perspective, and maybe someone like Women in Prison may be able to advise, the potential users of this service should not be mislead.

Yes it’s quite likely they’re using old materials, maybe pre April 2025, could even be pre Forstater.

You can ask your employer if the set up complies with the new guidance. You don’t even need to reveal which side of the fence you sit on- your question can be an open one.

At the very least, you should tell them that they need to be clearer about who the services are for.

Who is providing the service? Is it a charity or government organisation .

How old is the training? One option may be to enquire whether there have been any changes following the Supreme Court judgment and EHRC guidance

If you're in England, Scotland, or Wales, I would think the answer is obvious.

You either tell your employer that they are breaking the law if they allow men of any persuasion to use a single-sex service for females,

or

you say nothing, keep your head down, etc., if you want/need to. Not everyone is in a position to speak out.

But, your employer will still be breaking the law, even if you don't say anything, and they can, and probably will, be taken to court eventually.

If you are in NI, I'm really not sure how the law applies.

Report that the proposed service is potentially breaking the law to my line manager, adding that it is a concern that so would we be if we knowingly referred clients to it, and ask how I should approach this.

In writing so that it is documented from the start.

Ask them to explain how they manage the conflict between being trauma informed, and including men who identify as women in spaces women expect to be sex.
