NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #11

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

BU - yes, I'd reflected, slept, determined I wasn't willing to let a bigoted outburst and unpleasantness towards me stop me being who I was. I determined an alternate method of keeping safe, face this hostility head on. Unfortunately I got a fright.

Oh but yesterday he said he wasn't implying she's a bigot at all.

I've never had an issue with actual male doctors (I'm lucky enough not to have had trauma to make this difficult for me), but I would absolutely refuse any intimate related care from any man who thinks he's a woman.

I'd also struggle with any police officer who thinks they are the opposite sex.

It's such a breach of the tenets of honesty and integrity to me.

I also agree. I don't have any personal reason to be anxious around male professionals and have had obstetric care and assessment of a breast lump carried out by male doctors without hesitation, but I would be very uncomfortable to have any care beyond, "Can you confirm your name and date of birth?" carried out by a male practitioner trying to masquerade as a woman.

If that makes me transphobic, I hold my hands up. I'm not going to be told to ignore my own visceral reactions around a man.

They are notoriously opaque for getting individualised employment advice from an actual expert.

NC - so on Xmas eve you stood your ground, in early Xmas morn you were certain you don't feel safe when SP is there, but on 28th use CR anyway. Mixed messages, no?

BU - no, as I said, I was very afraid, very shakne, very distressed, freeaking out, trying to htink how I could keep safe from further aggression and hostlitiy. AFter speaking to family, contacted friend and gave general info about what happened, no name, no specificis, that I'd had an incident, would she accompany me, so that I'd feel safe. She chouldn't attend due to train issues. I thought I'd put my big girl pants on and be brave.

I think she is. And more than that, I think she's bringing some very salient points into a public arena that people wouldn't have been aware were happening... ie that a female patient who requests a female doctor could well be given a trans man without their consent

I'm petrified of this happening; having a transwoman gyni. And me saying 'absolutely NO' and wondering what the hellfire backlash that'll bring on me but it's a hill I'll die on if I have to. It's horrifying to think poor SP going through this, on her own. 😑
