nauticant · 10/02/2025 10:54

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

A doctor is not required. What about people.who have home.births and register the birth (with a sex) without ever going near a hospital?

NC - you're not a 'cis' woman, you're someone who has a biological [missed]

BU - the term biologically female is nebulous, no defined meaning in science, I'm not a robot, I am biological, I am biologically female.

Edited

No, but you are supposed to be a medical doctor.

murasaki · 10/02/2025 13:00

ArabellaScott · 10/02/2025 12:59

NC - you never sggested you have a DSD?

BU - no, giving a comprehensive argument

NC - leaving aside DSDs, doesn't take a doctor in majority of cases

BU - legally it's a doctor who makes that decision

NC - it's an observation, that any five year old could correctly make

BU - I don't know enough five year olds.

He shouldn't be allowed to know any 5 year olds.

Not a robot but his answers are ChatGPT level nonsense.

BettyBooper · 10/02/2025 13:00

DU - Im a woman and my colleagues would agree with me (!!!!!!!)

StellaAndCrow · 10/02/2025 13:00

Haha, he's weirdly trying to undefine five-year-olds now!

Because he was asked if a five year old would know the difference between male and female.

CoaltownFifer · 10/02/2025 13:00

Chrysanthemum5 · 10/02/2025 12:58

Clearly he is allowing his beliefs to influence his medical judgement

This, making his judgment unsafe and a risk to patients!

eatfigs · 10/02/2025 12:59

Is this a fitness to practice issue?

Surely it must be?!

Would he use male or female ranges when interpreting tests for a transwoman?

Would he prescribe drugs based on male or female needs for a transwoman?

Potentially very dangerous.

lcakethereforeIam · 10/02/2025 13:00

In the fullness of time he may find out how his protrate feels about that.

Or, he works in a&e, what would he do if Pete came in saying he was in labour?

frenchnoodle · 10/02/2025 13:00

It's all about power and control. He's loving it.

ArabellaScott · 10/02/2025 13:00

NC - insisting that SP and others accept you in the women's CR without showing discomfort, asking to pretend to be something you and tey both know is false

BU - no, that's not false, that's true. I'm a woman. I'm not forcing them not to be uncomfortable. I recognise they were uncomfortable .I didn't want to raise it further, raise a formal sanction purely because they were uncomfortable. They've chosenn non confrontation to manage discomfort, I'm nto going to force them to .... [missed]

Motorina · 10/02/2025 13:00

I want NC to ask, "Dr Upton, do you have a willy or a winky?", but that's probably not sufficiently judicial.

JasmineAllen · 10/02/2025 13:00

eatfigs · 10/02/2025 12:59

Is this a fitness to practice issue?

It must be, surely.

MatchaTea1 · 10/02/2025 13:01

WhatAMessWales · 10/02/2025 12:59

Wow. He says he's biologically female because he's biological and not a robot. And sex is assigned at birth based on medical professionals' best guess. Under oath. 😳

That's the kind of nonsense India Willoghby spouts on Twitter. I can see where he is getting his arguments from now - how embarrasing.

Taytoface · 10/02/2025 13:01

His obs and gynae rotation will be interesting. I would not allow anyone near me who does not understand the difference between the sexes

NotMaroonButRaspberry · 10/02/2025 13:01

NC - insisting that sp and colleagues accept you into their changing areas without any sign of discomfort you are forcing them to state something that isn't true

DU - no

NC - Insisting them to go along with something they consider false is bullying and harassment?

DU - no

ArabellaScott · 10/02/2025 13:01

NC - that insistence, that they pretend to believe something everybody knows is false is bullying/harrassment

BU - I haven't insisted - it isn't a falsehood, it's not bullying or harrassment

EasternStandard · 10/02/2025 13:01

Brilliant bullying and harassment exactly

Jimmyneutronsforehead · 10/02/2025 13:02

How can NHS fife want to keep this doctor under employment if their beliefs so defiantly contradict medical science

Iamnotalemming · 10/02/2025 13:02

Why can't he find a way to manage the uncomfortableness?!! I'm raging. I think NC is too, her face is red.

murasaki · 10/02/2025 13:02

It's one thing Bob from IT spouting this bullshit, and quite another for a practising doctor.

eulittleb831 · 10/02/2025 13:02

Motorina · 10/02/2025 13:00

I want NC to ask, "Dr Upton, do you have a willy or a winky?", but that's probably not sufficiently judicial.

define willy or winky would be the response

RobinEllacotStrike · 10/02/2025 13:02

I would like the Judge to remind DrU that he is under oath to tell the truth

ArabellaScott · 10/02/2025 13:02

Judge explaining to JR that it's not for him to dictate what questiuons are asked.

JR - intervention based on contravention on 1st Rspondent's bullying and harassment policy needs to be made clear
