Lambeth Council to challenge new “discriminatory” guidelines on single-sex spaces

Lambeth Council has signalled it will resist new guidance on access to single-sex spaces, over fears that it risked “leaving trans people open to discrimination”.

Councillors backed a call for the council to refuse to implement the “Draft Code of Practice on Services, public functions and associations”, if the council’s legal team confirms the move would be lawful.

The Equality and Human Rights Commission (EHRC) published the updated code following a Supreme Court judgment last year, ruling that “sex” in the Equality Act 2010 refers to sex assigned at birth.

The draft clarifies that service providers may legally restrict single-sex spaces, including changing rooms, to biological sex.

But a motion to a Full Council meeting condemned the draft code as “incoherent and self-contradictory, discriminatory, and impossible to implement in a reasonable and proportionate manner”. It called on the council to “protect LGBTQIA+ workers and service users” by refusing to implement the guidelines.

A majority of Calderdale councillors have voted down calls to denounce guidance from a public body as discriminatory towards trans individuals and impractical.

Instead, they determined that women's rights as outlined in the guidance should take precedence in decision-making. The Green Party contended that the Equality and Human Rights Commission (EHRC) guidance, which requires businesses to provide both single-sex and mixed-sex toilets and changing facilities amongst other measures, would also impose financial burdens.

Oh! now they want a debate, such unhinged stupidity, it's a guidance it doesn't have to be debated, and Bridget did all she could to torpedo it, they're so ungrateful.

In this case, it appears that it is not the council, but the West Berkshire TransActual Group, and a few "businesses " who have written a letter to their MPs.

They’re a bit behind the times, that ship sailed on 9 July.

So we will have to wait and see whether the Council will be allowed to get on with its job of implementing the law, or will get caught up in a drama about the most discriminated against group in the whole wide world.
