So Doctor “ Beth “ Upton is off to pastures new , leaving a large ongoing bill for NHS Fife

Dr Upton is off to Australia it seems, after creating a toxic situation for women in NHS Fife, wonder if Dr Upton is going to be working in “ Gender Services “ down under ?

But the TRAs all wanted the word sex removed and replaced with gender.
It would have rolled right through the service objective and undermined the aim of the wording which was to provide the victim a choice if there was staff available

The aim was also to have a majority female staff to best meet the needs of majority victims.

If gender had been allowed
This would have allowed a male to apply as a female.
For him to be ranked above other males when the service were making provision for more female victims so could hire on the basis of sex.
To be assigned to a female only on call list
To be brought into the room after the victim was told that a female examiner would attend.
Etc

So no informed consent and coercive control by staff resulting in a male carrying out a sexual assault while examining the victim of a sexual assault wit an objective of convicting the first sex offender but not the second.

TRA did not see the problem with that.

I think you have identified the only, and the very unlikely and extreme case, in which I'd be prepared to let DrU treat meSmile

In all other circumstances, I wouldn't want to be treated by a doctor with such a bizarre take on human physiology, who is clearly not entirely in touch with reality because he stated under oath that he is a biological woman, and who is quite upfront about his willingness to be deceptive about his sex to woman patients.

As an employer, I'd be worried that his hypervigilance about slights, real or imaginary, and his litigiousness, would make him a tricky person to manage.

As a female colleague, if I was one who, unlike him, sticks to scientific rather than ideological definitions, I'd be concerned about my name appearing on the same roster as his, as it would be a nightmare to have to work alongside someone with so many limitations, professional and personal.

You use the word 'prejudice' - the word means a preconceived, and therefore unfair, opinion formed without any actual experience or facts.

None of us knew DrU from a hole in the ground before the NHSF tribunal, so you are incorrect to use the word 'prejudice' - my opinion of DrU is based on his own words, spoken under oath, to an Employment Tribunal.
That's not prejudice.

And he expects if a female, rape victim or not, asks for a female medical examiner that he, a male, should be allowed to be that medical examiner because in his opinion he is female.

Much like the creepy fucker at Edinburgh Rape Crisis he doesn’t think it’s the business of women to know that he is not a woman.

When I was raped I asked for all female staff and minimal people around. Whilst being examined I was in such a state I couldn’t tell you who was in the room, if they were male or female, how many people were there as I had my face buried in an ice pack - I just trusted that my request was respected. Had Upton been in our area it may well not have been and that’s simply not acceptable.

True, and they can then refuse the male who wishes to carry out examination. If there isn't a woman available one cannot be spirited up but perhaps they could delay the examination until the next shift come on duty. Very reasonable.

This chap would likely then make a formal complaint about the patients conduct being transphobic against him personally, and make himself the story rather than seek to support the woman in her legal, appropriate choice.

Rape victims are usually directed to a SARC which is all female.

Female rape victims certainly have the right to refuse examination by a male doctor in an NHS hospital.

This guy takes notes of every glance he feels is hateful - this won't be his only delve into an employment tribunal I'm sure.

His judgement and his ethics are very much in question. If his behaviour around female patients is anything like his behaviour around nurses - I’d steer well clear.

Grimy it shows how important it was when Scottish women forced the legal provision for medics in an Examiner role in Sexual Assault cases to be of the sex requested by victims.

I think, as PPs have said, he's just finished his contract there and has either moved to another role already or will be moving to another role.

Can he go abroad if the EAT is upcoming? Is he needed for that, especially if its sent back to be re-heard?

I think this is a non story. He is a recently qualified junior doctor. Most junior doctors move a lot early in their careers. Posts rotate every January and August. It is likely his short term training contract with NHS Fife finished and he has moved to a different area like many junior docs. This shouldn’t be news.

Where he goes absolutely should be news. Women wherever he goes should be aware they are dealing with a man who doesn’t believe informed consent should apply to his patients.

Because he’s stated he would ignore consent and so basically sexually assault a woman. He should be struck off for that alone.

I feel sorry for anyone who may be treated by a medic who thinks that the need for informed consent doesn’t apply to him.

More boringly, I suspect his contract has finished in Fife. There is a recruitment crisis for junior doctors making it hard to get a job in the UK at the next step on the career ladder.

Having been off sick for ages won't help his job applications, even though they are all done anonymised.

We export loads of doctors to Australia and New Zealand every year - if he can't get a job in Scotland, Australia is the obvious place to go, especially as he will know where to go for the highest level of trans protection.

I couldn't think of a worse place to go if you're a pretend Sheila 😂

You're making a spectacle of yourself here. The entire point of the case was that Dr Upton is male. There is no question about this. In the English language the pronouns for a male person are he/him/his, not she/her/hers.
